Possible upcoming party wall problem.

We've been thinking for a long time about extending above the garage. However recently noticed that the neighbour has essentially built on our side of the party wall.

If I was to build up then I would fall foul of the cladding on the side of the neighbours house as well as their roof!

On the extension they've built above their garage the roof actually slopes towards our property and has a gutter overhanging our garage. Spoke to the missus dad who was a surveyor before he retired and hes sure that the roof they have whould have been tilted back not towards our property.

If we do go about extending the garage would the neighbour be liable to pay for the corrections to her roof?

Just thought I'd have an ask here and see if I could get some input :)
