Returning an assembled bike?

I bought a bike off Very with my account. I assembled it correctly with a friend's help. The brake makes a terrible noise no matter how I try to adjust it and the pedals do not go around when it is cycled forward. My friend has assembled bikes before so we did nothing wrong. I also found I am too short for this bike (5'2) so I just want to return it. I checked reviews before I bought, one stated not to buy if below 5ft as it is too high. I'm taller than that so went on this.

I emailed them and called them. They said they will sent a man to check faults but will charge me £45 if nothing serious is wrong. I don't have this (hence why it was bought with my account). I just want to blood well return it and find one that works and will fit me. What can I do? I can try and disassemble it but maybe this would not be accepted either?

I didn't even know bikes were so tricky to return!! What are my rights and what can I do??
Up and onwards to the future!

If you are confident the bike is faulty there will be no issue, you will not be charged. You are confident of this, aren't you?

For future reference, you can often pick up old bikes on Freecycle etc. This would be a far better idea than buying one you cannot afford.
  • I bought it off Very as I don't trust bikes bought second hand. It's like cars. I don't have a clue what's wrong with it or if the seller is having me on. I thought buying new would ensure it lasts and is in perfect condition. I pay £40 per month for a bus pass. I got the bike to get used to and use as transport, enabling me to scrap the bus pass entirely.
Up and onwards to the future!

If you don't know what you're doing with a new bike, there is no reason why an older one would be any less reliable! If you don't know what is wrong then you have two options - get someone that knows what they are doing to have a look at it, or allow the Very representative to do the same.

Sorry to be a pain but... did you not read the inside leg measurements when you ordered it? and Do you mean if you push the bike the pedals dont go round? if so then that's correct - the pedals shouldn't go round when the bike is pushed forwards.

This guy has summed it up.

Either you are confident that the bike is faulty or you are not.

    Saying things like;

My friend has assembled bikes before so we did nothing wrong

suggests that you are in the right.

In such an instance you are perfectly entitled to a refund, repair or replacement which does not cost you any money. Sounds like very have advised you that this is the case. The fact that you have assembled the item may limit you to a repair only but that is down to the Sales of Goods Act and more research will need to be done (you may have accepted the goods by constructing it)

Should you be in the wrong, then why should the seller have to pay for your mistake? If you and your friend have assembled it wrongly then the seller shouldn't be out of pocket for this.

That is the bottom line bro. If it is a genuine fault then expect a free repair. If it is your fault then you've gotta pay lad. Simple as that

Noisy brakes are generally caused by slight misalignments etc.

You can't return something on the basis that you relied on a review in making your choice.

I'm not sure how much weight would be attached to a statement that your mate has assembled bikes before, either he is a professional or an amateur.
