access for water

Hi looking for advice for my mum
Her property is next to a plot of land which has been given planning permission for 3 houses. It is on a hill and fairly rural they want to access her garden so they can connect water to the property's. They have asked her and said they will redo her drive and give her compensation. My question is how much compensation is fair. They have started to clear the site ready but only just asked her

  • Are you sure it's just to connect to water?

    What about other 'mains' services like sewerage, gas & electricity?

    It might be worth checking with your local planning dept' as to how the developer intends to connect these services. This info will have been provided to the planners before full consent can be granted. Sometimes this info is readily available online, it certainly is with my local council !

    It's possible that the developers are just looking to cut costs & routing the water main through your mothers property will save them a few £1000's. I cannot imagine them wanting to do it for a few £100's.

    If this is the case then I'd be looking at least half of what it saves the developer plus the acceptable reinstatement of the excavations together with a time frame that has penalty clauses.

    I wouldn't trust the developers figures either, I'd get my own rough costs as to which each method would cost them.

    Then I'd need a legal contract that sets out who exactly is responsible in the future for the pipes that cross my land.

    But then again, I'd not even entertain the possibility of even the remotest prospect of getting involved because it can only ever be saving the developer a few £1000's at best . . . or there is something decidedly dodgy & underhand about their motives !
