court date tomorrow HELP!

Ok so my court has given me a last minute appointment for tomorrow. This is good except it doesn't give me the time to sort out what happens with my maternity allowance payments as I presume I will lose my bank account tomorrow.
I know I can open a post office account but can anyone tell me how I go about changing my maternity payments? My next one is due in on monday will it bounce or go in without me having access to it anymore?

Without doing a search to bring up your history......go into Barclays after your Court appointment.

Open a new basic bank account.

Who is your present account with?

If a bank freezes[locks] an account when BR is discovered, they cannot keep the cash.

Likewise if they close an account.
No, I don't think all other drivers are idiots......but some are determined to change my mind.......
  • If your account is frozen (chances are it won't have been done by Monday, as the OR has to contact you first and then has to send a letter to the bank). Then the OR's would send a fax to the bank requesting that any money in the account be released to you.

  • Thank u both, it's a current account with coop I have. Hopefully then I can withdraw myaternity on Monday and give me a chance to open a new account and change banking details. I have debt with Barclays that's why I thought if have to do post office account. Also if I goto Barclays do I tell them I've just been declared BR that morning?
  • You should tell them at Barclays that an Order has been made, hopefully it won't make any difference to them and they will open you a new account. You can only try. As you already have a debt with them, they will eventually be notified of the Bankruptcy Order, so it would be better to be honest with them from the start.

  • Do you have any debts with coop? If your account is not in debt you could try ringing them today and asking to downgrade your account to a cashminder account, I don't know if they would agree but it's worth a try if you are resigned to the idea of your account being closed anyway?

Good luck tomorrow, it won't be as scary as you are imagining, try not to worry about it!

Why not call the co-op and ask for your account to be downgraded to a cashminder one? you'll be able to keep it then. They may even let you keep one of their none cashminder accounts, but would remove the credit facilities.
  • The co-op will close your regular current account once the OR informs them. Its quite likely that nothing will have happened to your account by Monday and you will have time to draw the cash out but it depends on how busy your OR is.
If its statutory maternity benefit you can usually change your bank account details online at the .gov website
Cancel all your DD's and standing orders so that none 'bounce' in the interim.
I doubt if the co-op can actually 'downsize' an account to a basic. BUT the co-op wont let you open any account even a basic one once you are actually BR - you would need to wait until you are discharged to get one there. Don't worry about the Barclays debt - after tomorrow you wont have one!!
After court go to Barclays and make an appointment to open a basic account (in fact open two so you can use one as savings/budgeting account) Once you have the accounts open you can make arrangements for all your regular deposits and payments to be done from the Barclays account.
  • Thank you all, I will goto Barclays after court tomorrow. I am so scared of going through with this. Not the BR itself but the judge part. I'm also struggling to fill out the 6.27 form-I called today for an appointment expecting to wait a month but got a last minute for tomorrow.
Is there any chance they could laugh me out the door and refuse to grand me BR-thats my worst nightmare.

I worried about that - in the end I was in there for less than five minutes! The judge said to me 'oh dear you have got yourself in a pickle' signed the papers and wished me the best of luck!

The judge was very professional and serious - one thing she did ask was about the advice I had been given. Everyone seems to be asked that question so make sure you have taken advice and can tell her about it. ~ she needs to be sure you understand the implications of being bankrupt.
