Hi,
Sent my HTC for repair, to HTC, as glass had fractured. I had put I it in my work bag, in a protective case. Got home took it out, and glass had fractured. Now I do expect to be able to carry my phone, in a car, in a bag without it breaking. Nothing more fantastic than diary and notebook in this bag.
HTC are stating repair is not covered by warranty. When I booked repair on phone they said there is a known fault with the glass fracturing from the edge, which I think this must have been.
Please advise on my legal situation and rights in this case.
Helpful replies much appreciated.

Its damaged in HTCs view and if you dispute that its been damaged then you need an independent report .Also ask HTC for the report on the phones damage .
As you sent to HTC not the vendor assumption is that its over one year old and no longer under the vendors warranty .0
