Rather angry - Work blunder

So our business runs it annul leave apr to apr. It was brought up in a employee review meeting that this is causing issues as most partners were on a Jan to Dec and it meant that people were having to save leave or be using leave up at different points of the year making childcare troublesome.
The business said suck it up.
The business then had pointed out to it that our contracts show a Jan to Dec annual leave agreement. Suddenly it was all steam ahead and people that wanted to change could.
I got an email from the gent tasked with doing the swap over and realised at once he had not pro rata the leave down. I went over and mentioned that he was stating that I has 10 days of leave left to take and should that not be reduced to 2? no i was told your A/L is your A/L and i had 10 days to take.
I went back to my desk and thought this is not right. Emailed my TL. She wandered over to the the gent in question and was sent away with a flea in her ear and told that we didn't know what we were talking about and to stop telling him how to do his job.
A week later and i was hassled to book my leave. I brought it up again how this could not be right and it was once again taken up with the Gent in question. I was then assured that come hell or high water i DID have those days to take. yes, this is in writing.
I was made to take the days under the threat of losing them.
While i was away on leave my TL had had the opportunity to have a word with the big boss who realised the issue and the brown stuff was flying around. They realised that about 30 ppl had been advised to take days they were not entitled to.
So today we waited with bated breath to how this was going to be rectified. We had all submitted a request to work the time back.
However we were told today that they are not going to allow us to change the year (even though its in our contracts) until the year after next and all the leave we have taken will be deducted from next years entitlement and working back the hours would not be considered.
So i have taken ten days i didn't want to only have 15 days off the whole of next year.
to complicate matters i have preagreed holiday for 17 days Feb next year to travel abroad all booked and paid for.
They have advised they will not honour this leave.
i should be in bed now as its 2400 but i am so angry i just cant sleep.
Oh and the email that said i was entitled to those 10 days... well apparently the big boss said in a rush... it states am entitled to those 10 days...which is am.... out of next years leave but he left that off the email, sorry about that. ....... talk about distorting the facts!

I should be in bed also but thought id msg back before i go. It's so furstrating when other people who can't do their jobs mess everyone elses lives up! Do you have a union? I would def stand your ground with this one. The least they could do would be to allow you the booked holiday. Sorry not much help!0

I would be absolutely furious too. They might be in their right to act as they are, but such attitude really show extremely poor management. Personally, if it was me, I would be looking for another job and do only the strict minimum to meet requirements in the meantime.0

What does "preagreed" mean? Have you had the leave authorised?
If not then you may well lose the holiday so I would be looking to cancel sooner than later to see what money you can get back.0 -
The law says that you are entitled to 28 days statutory leave (including public holidays) every leave year. Full stop. It does not say that you are entitled to 28 days holiday unless the employer screws up their calculations the year before. There is no legal right to carry over statutory leave (there used to be, but that disappeared a few years ago) - it is use it or lose it, and the employer must allow employees to opportunity to take their leave. the same applies the other way around - there is no legal right for the employer to "deduct" from the basic statutory entitlement for a year. The only right they have is to deduct payment for overtaken holiday at the termination of employment where the employee has taken more holiday than their entitlement. So the employer must find another way of resolving this - they cannot reduce your holiday next year unless they give more than statutory leave. Of course, you need to balance your demands with whether or not you will like the alternative - they do not have to accept your proposal of working the time back, and may look for other equally unacceptable ways of resolving this.0

This being base on a 5 day working week, employees working less than 5 days should be pro rat'd and those working 6 days being limited to 33.6 days.
Additionally, this assumes Tygermoth isn't on better leave arrangements.
OP, involve trade union.Don’t be a can’t, be a can.0 -
When did this change? I thought if they worked more than 5 days it still stayed at 28 days? This being base on a 5 day working week, employees working less than 5 days should be pro rat'd and those working 6 days being limited to 33.6 days.

I just don't get why the employer isn't allowing you to work the time back, unless they are struggling financially....just bizarre.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
It didn't change, fast fingers slow brain - my bad.Don’t be a can’t, be a can.0

.
I was assuming full time or almost full time on the basis that s/he said that if the ten days were deducted from next years allowance then that only left 15 days holiday (25 in total then - which is very close to the 28 allowing for maybe some fixed days at Christmas). So it seemed unlikely that there were additional leave entitlements - which of course could be "deducted from".0 -
CAB could help with this. Do you have with any insurance policies with a legal advice helpline attached?
Your employer could ask for the holiday money to be repaid, which could be as much or as little as you agree to pay it back as ie £2 per week or £20 per week.
Also, just because your company might not/does not recognise union membership, does not mean that you cannot be a member of a union and therefore entitled to ask for advice.0
