Landlord broke the contract

  • The new flatmate has presumably paid money to my husband as the landlord has not received anything.

When the flatmate moved in I asked for my name to be removed from the lease. The landlord said that he *couldn't* change the lease until it expired in October. On advice from Shelter I informed him that he, in fact, had the right to change it at any time if the tenants agreed, which I did. He ignored my emails on the matter after that, so the lease is still in my and my husband's names.

No change has been made to the deposit's status. The deposit was paid entirely by me and I expect to lose the lot to cover my husband's unpaid rent. I'm also expecting to pay the rent shortfall and the interest on the unpaid rent. My husband? He will simply ignore any court orders and skip off home to Ireland leaving me to carry the can. This is of course after he has bunkered down there for as long as he can till the bailiffs arrive "sigh".

I'm just gutted that I am going to be held financially responsible for my husband's actions. There is nothing the law can throw at him that he won't ignore...

I offered the landlord a quick out, by getting an occupancy order at my own expense, but he has ignored this and sent several notices saying that he's going to get a section 21 and a section 8. If he had let me do it my way I could have got his apartment free of these squatters weeks ago.
