Severe Disability Premium & Industrial Injuries Benefit Info Please?

Hi
Could I get some advice for my uncle if possible please.
He had been in receipt of Inc Ben for a couple of years due to an accident at work.
He received an ESA 50? in October last year and sent it off, 10 months later a letter arrived and advised he has in the past month been migrated onto ESA Support Group - Contributions based.
He currently receives the following.
DLA Middle Rate Care
DLA High Rate Mobility
ESA Support Group CB
Industrial Injuries Benefit.
He recently received an application to apply for Severe Disability Premium, and is wondering if he should apply as he wasn't sure if this would be paid alongside IIB.
He lives alone and no one cares for him, but is just wondering if there is an entitlement along with the other benefits. Also, he has never been invited to apply for this in the past, so is there a certain benefit that has triggered the system at DWP to send him this application for SDP?

You can be awarded SDP if you get the middle/high care componant of DLA and have under £16.000 in savings and know one is claiming care allowance for you. You also need to live alone
I would put in the claim because the worst that can happen is not entitled0 -
Thanks for your reply Richard. He doesn't have savings apart from a few hundred pounds in the bank. He does live alone, there isn't a carer and gets the DLA middle rate.
It mentions on some sites that its an income related benefit that triggers SDP but as far as I am aware none of the benefits he gets are income related so I thought there would be no entitlement to it. I will however help him fill the form in if needed and see what happens.
Would anyone know if the IIB would affect the SDP?0 -
it is all income dependant. how much is his industrial injuries benefit?
he can receive conts based benefits, but they will be topped up with income related benefit if his income is low enough.
if his industrial inhuries benefit uis less than around £60 a week it would be worth him applying

You need to look on the award letter for his ESA and see whether he has any premiums added.
If he is only on contribution based ESA then I do not think he would be getting any premiums added. You need to check.
If he applies for income based ESA (and from what you say he meets the criteria) then he could get disability premiums added (extra money basically)
However, as soon as his ESA becomes income based then the whole of his Industrial Injuries Benefit would be counted as income and deducted for his ESA.
It is a case of doing a better off calculation. (CAB can do this for you)
ESa premiums are not my strong point but was wondering if he also might be entitled to the Enhanced Disability Premium as well. (needs high rate care DLA for this so not eligible)

It's all very confusing isn't it.
He did fill in a form for IB ESA after being migrated over to the CB ESA, DWP advised him to do this, then he had the letter advising him to apply for SDP, so I assumed he has been given some form of IR topup, but I can't see any mention of it on the letter.
He does get a premium for being in the support group, its called a disability premium I think, but it isn't a large amount of money.
Also, to confuse it further, he rang them on receipt of this letter as he didn't understand it, and they said he is not on IB ESA - He is on CB ESA. They said he is being kept on CB ESA because he would receive less on IB ESA.
Nannytone - he receives just over £49 a week IIB.
Pmlindyloo - where you say his IIB would be counted as income, they haven't done this, and this is stated on the letter, as they said it would have reduced his benefits. It says something like on ESA IB he would get 'this much' so he is staying on CB ESA which gives him 'this much' ie more money. So they say he is having more money for staying on CB as IB would see a reduction in his benefits.
This is where I cannot understand why he had the application to apply for SDP - It seems that the letter says 'we are keeping you on CB, because if we give you IB it would reduce your benefits. SO with this in mind it shouldn't have triggered an application for SDP?0 -
I have the letter here. It says.
Your living expenses - £72.40
Extra money because of the disibility income guarantee - £87.95
Extra money because you are in the support group - £35.75
Which gives a total income-related amount of £123.70
Income and Benefits.
DLA care comp for you is not counted as income towards ESA
Ind Inj Dis Ben for you - £49.80
Your total income £49.80
Your income related amount is £123.70, less £49.80 so you would have been entitled to £73.90
However, because you are entitled to CB ESA we will pay you £115.10
Top up payment £6.95 (this is the guarantee to prevent you from being worse off)
The amounts on this page apply from 9th August 20140 -
the letter inviting him to claim SDP is yjr income relayed part of the claim.
he receives conts based ESA and the SDP would be the income related benefit top up.
as his industrial injuries benefit is classed as income, it will be deducted from any income related award, but would still give him and extra £15 or so a week, plus entitle him to full housing benefit, maximum council tax support ( for his area) and free prescriptions/dental/eye tests
