TC overpayment

Enforcement action means passing to a debt collector, taking you to county court, bailiffs which are all options open to them if you ignore it.
I would never suggest ignoring it as an option. Either agree a time to pay, dispute or appeal it (after finding out the explanation) or do both but doing nothing will only lead to further problems.

Thanks, I am not going to do nothing, I am going to apply for a DRO and include this overpayment in it.0 -
I also thought they could take it out of your current award?
There are so many now who have been told they have had too much TC and have to pay it back.
Its a messed up system, messed up for the economy when all these ones like me just cant pay it back. We have to go under with a RDO or something.0 -

Tax credits have been taking overpayments from existing awards for years now providing it is for the same claim.
I thought the only difference was that in October they planned to extend this to claims that had previously been closed and in certain circumstances?
BB - yes that is correct.
I may have made a presumption without actually clarifying that the claim ended. Normally you only get a demand letter/TC610 if it is direct recovery, you wouldn't get a separate letter if it was ongoing recovery it would just show on your award notice. I therefore presumed it was direct recovery. Ongoing recovery is automatic - you don't ask for it.
John Lewis - can you confirm what type of letter you received? They will only take it from your ongoing payments if the same claim is continuing. If that was the case, you would just receive your current award notice and in the back section it would show the overpayments being recovered.
If you got a letter asking for direct payment that means there has been a break in your claim.

Yes it is a tc610
But there was no break in my claim. What does that mean?
It is for period ending April 2013, and I have been claiming TC all the way through until now.0 -

Have you ever went from a single to a joint claim or vice versa?
At that time were you claim working tax credits, child tax credits or both?
Do you still get payments now?
always a joint claim and still getting it now.
yes it was wtc + ctc then just ctc and now both again.0 -

You might want to query that with them. The fact you have a TC610 suggests they think there is a break in your claim, which if not correct could be the source of the overpayment.
You will need to speak to them to find out.

There is a break from WTC to JSA then back to WTC, but CTC all the way through. But my TC610 says £250CTC and £250WTC was over paid?
Contacting them is proving difficult. I was on the phone for ages putting in £1 coins waiting today. I had a pocket full of change but after over 40mins the money ran out
How annoying is that. I then decided to go round to my local office only to find a sign saying it has closed down and to ring the number I had just spen almost an hour standing in a phone box
Is it not possible to email them? Any other options I cant keep putting in £1 coins in the phone box, it drives me crazy.0 -

That wouldn't be a break in claim for these purposes. It would be an actually ending of both for some reason.
The only other way to contact them is to go to a local CAB or similar and get them to ring for you.

Thanks that is my best bet. It is such a shame you cant email them.
For now I will write to them explaining that I spent 45mins in a phone box and didnt realise how many £1 coins they would take off me for being on hold for so long!0 -

I will ring today and ask for explanation, then appeal because I think its wrong.0
