hi, can someone help me I've been on the normal websites and cannot get a conclusive answer; my husband is 60, has incurable cancer and his company are going to medically retire him, he has a work pension of £162 per month, i work full time and earn £18,000 pa is he entitled to contribution based esa; approximately how much or will my income affect it in a way that he will get nothing.

Has he worked full time for the last 2 years or so? He may get contributions based ESA if he's paid NI.
If he gets contributions based:
- your income is ignored
- any pension below £85 per week is ignored. After that, half the excess is taken as income. IE, pension of £100 per week - 100 - 85 = 15 / 2 - 7.5. £7.50 per week is deducted from ESA.

I would also ring Macmillan nurses up too. Im fairly sure you can get fast tracked PIP if you are diagnosed with terminal cancer.
Or it could be attendance allowance.

This is true, yes.

If he earned:
£5,100 or more in 2011/2012
and
£5,350 or more in 2012/2013
And he makes his claim to start in 2014 Then, yes, he will be entitled to ESA Conts. Your income will not affect it and he will get intially £72 a week rising to £101 or £108 per week.
Because he has cancer he might get automatic entitlement to the Support Group (£108 pw) as soon as his claim is processed.
If it is terminal ask the doctor if he is entitled to a DS-1500 form which he can send in with his claim He won't need sick notes if he gets a DS-1500.
He can backdate a claim a max 3 months, with DS-1500 or sicknotes that cover the 3 months, as long as he wasn't working or in receipt of Statutory sick pay.... Employers sick pay is ok, he can claim whilst he gets employers sick pay but not statutory sick pay.0 -
thanks so much it seems that everyday i find out something new, i shall be ringing the dr tomorrow about the form and will try and get the esa backdated.0
