Is this correct procedure?

Apologies but I just want to check this right. I've tried to follow the instructions on here. I have received a Parking Charge Notice form Parking Eye that states under paragraph 9 (2) (b) that the driver is required to pay a charge for overstaying by 51 minutes a three hour free car park.
The warning is given under paragraph 9 (2)(f)
From what I can make out on here I have to write a letter to their appeals department stating the charge does not accurately reflect the costs they have incurred. I then wait for that appeal to be denied before taking it to POPLA.
Am I right? Have I missed anything?

    Essentially yes. Use the appeal word for word in the newbie thread, appealing as keeper.

  • I only refer to point a on the template, is that right.

    Why do you feel that the following points 'do not relate to your particular case'?
    b). The signage on site is deficient and fails to comply with the British Parking Association's Code of Practice, Annexe B.
    c). In the absence of any evidence it is my case that you lack any or sufficient proprietary interest in the land.
    d). Your notice was deficient and fails to comply with Schedule 4, Protection of Freedoms Act.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    When I said refer to post 1, I meant the whole of post 1 in the newbie thread. Of course the other points apply to you. They apply to all PCNs . It's a generic appeal. Do not alter, amend, rewrite, rethink, or change it to suit. Why Not? Because it has been written by an expert and unless you are an expert it is wise to bow to experience in these cases. Trust us!
