Spousal Maintenance

Hi,
Since 2009 I have been paying £600 per month spousal maintenance to my x-wife by court order. My income has gone down a huge amount but I don't know what to do, can't afford it anymore. All kids grown up and working. I went back to court a while ago when my income went down but the District Judge would not reduce my payments. Don't want to pay thousands more in legal fees and end up worse off. I am very responsible person but feel victimised as my x-wife is mobile and carrying out a normal life but says she can't work. Any advice please.

    I'm not sure you'll get far if a judge has already spoken though.
  • Is there a reason that your ex-wife requires maintenance from you? I was told that there wasn't a chance for any for me when I divorced, even though I am sole carer for our disabled child and have no way of earning at all for the foreseeable future.


    If you have legal help on your house insurance, it might be worth giving them a ring for advice.

    The only people I have to answer to are my beautiful babies aged 8 and 5

  • A district judge is usually found in UK County Courts who deal with Family Law etc.


    I am guessing that there is likely to be a lot of assets otherwise the judge would have reduced the monthly payments.
  • I am in the UK - I have not assets, my house was signed over to my x-wife in return for me getting my occupational pension, which I was not happy with but my solicitor said it would cost me thousands of pounds to continue with the case which I did not have. I have no assets at all except personal belongings. My x-wife claimed she was not able to work so I would have to support her for life!
  • Tell her to "do one".

    There must be more to this story.

    Spousal maintenance is so rarely awarded the judge must have had some reasoning for doing so and the second judge has seen fit not to reduce the payments. The OP's own lawyer is suggesting it would be a difficult decision to challenge.

    I know someone it was awarded to and I have no idea why, both have full time jobs.
