  • If I'm going to the expense of replacing the worktop then I'd rather pay someone to do it - I don't have a jigsaw or circular saw and most of the worktops advertised on ebay are collection only and my car isn't big enough to carry it.

    Getting a worktop is cheap enough, and it's just as cheap to get someone to do it, but my query was should I be paying to replace 3m of worktop (including replacing 2.5m of worktop that's seen better days but that I haven't damaged) when the part I damaged is less than the size of a dinner plate and is on a separate section of worktop 23.5 inches in length.

    WRT the wardrobe door, I can see why 50% is reasonable in your case

    I hope it works out for the OP because I find it refreshing they are taking responsibility for their actions without threats of legal action against the LL as you suggest. Let's hope the LL does the right thing in this case and treats the OP fairly.

    You and me both! I'm not out to rip anyone off, or threaten legal action etc I just wanted to get an idea of what others would do and what legally I HAVE to do.

    My LL isn't a professional, and there's a lot that should have been done that wasn't and I've let it go, but i'm not looking to benefit from the situation :)

    Where was the threat of legal action? All I said was that the OP could claim compensation for non-protection of deposit. If you read my other posts you would also see that I went on to explain betterment so that even if the LL had done things properly the DPS still wouldn't award them the cost of a brand new kitchen worktop.

    It's lovely that the OP wants to take responsibility for their actions, it's just a shame that the LL hasn't carried out their legal obligations.

    OP, I'd suggest that before you move out, you take photos of all of the kitchen so that, if push comes to shove and you do have to argue about not paying for the full cost of replacement, you can evidence the sort of age of the whole kitchen i.e. how long it had been in situ.
  • I'd just be honest with the LL, explain the damage, and see what s/he does.

    My OH burnt a ring into our last rented property's worktop. I did a 'fix' which was good enough for our use, and when we did our leaving inventory I pointed it out to the LL (who hadn't even noticed!) and he said not to worry about it as he wanted to change the kitchen anyway.

    He appreciated the honesty, I appreciated not having to pay!

    If you LL does seem like he's taking the !!!! then with no check-in or protected deposit he hasn't got a leg to stand on. If you still wanted to be fair to him, get a quote for a tradesman to come and replace the worktop, and offer him what you think is a fair cut of that.
