Argos Bush Cooker...won't refund : (

I bought a Bush electric cooker from Argos York in October 2013. Within a couple of weeks I realized it wasn't heating up properly, the engineer was called out and the base element was broken. Now it is broken again, only heating up half of the oven! I suspect it's been like this for quite a while as it has taken forever to cook things thoroughly. My daughter has Aspergers, and she is very sensitive to foods not being "well done", so it has caused a lot of stress :(
I phoned Customer services on the 16th September, when "David" said he'd refund me the cost of the oven and I could pay the extra towards a new oven. Yesterday, on the same Customer Service helpline, "Kim" said there was no record of that having taken place, so I am entitled to nothing.
I'm really upset as I can't trust this oven to be honest! It breaks down frequently, so how can I be sure it'll ever truly cook things thoroughly when it hasn't! Surely we're entitled to some sort of compensation?x:A

    A full refund is unlikely as you have had use of an oven for nearly a year. Yes you had some early initial problems but they were sorted.

    What 'compensation' exactly do you expect? You say you feel it has been like that 'for a while' due to your daughters behaviour, yet you didnt do anything earlier so Argos cannot be held accountable for that. You say it breaks down frequently, well its broken down once, and now its broken down a year later, probably not what would come under the grounds of 'frequently' More than you want, sure, but not frequent.

    Legally, you can ask Argos to replace, refund (probably partially) or repair the oven. They have the right to choose what. They ALSO have the right to make you prove the fault is inherent, as you have had the oven over 6 months, by getting your own independent report. If it proves the fault is inherent, Argos must cover the cost of that report. If you don't have any record of Davids conversation in writing or a recorded phone call then there is nothing they can do about that as legally what David promised is WAY over and above the law.

    Just out of interest, do you have aspergers, OP? I'm kinda surprised that you haven't realised that an electric item has a chance of being faulty.... With such knowledge you would presumably have some other way of making food "well done" and thus accommodating your daughter's needs in the event that your bush cooker failed....

    I suspect that either;

    1. You've just put all your eggs into one basket with this bush cooker and kinda neglected (in a slight way, to the same extent you are implicating argos here) your daughter's needs

    2. You are merely mentioning it as a sort of way to make people/argos feel guilty or sympathetic
