hi people,
im basically on here for my mum and dad as they are not tech savvy when it comes to online forums, so thanks for taking time to read this!
anyways, can someone help my parents in regards to PPI lawyers that can resolve an issue with insurance that was taken out on a credit card early '2000'
basically, my dad was self employed at the time and due to work drying up back then and him being admitted to hospital with a hernia problem which in turn lead to an operation, my dad couldnt afford to pay his credit card (American express) at a balance of around £1500.
now at time of acceptance and misc purchases over time my dad has always taken out protection insurance in case of injury or any health issues (as above). this was done through London Edinburgh referred from American express with payment either going to American express to pay them or my dad paying London Edinburgh directly (cant remember!)
when my dad recovered from his operation he wanted to claim for the time he was ill up until he was fit to work again. so when my dad tried to make a claim he was told he that because he was self employed they wouldnt pay out to cover credit card as it didn't cover self employed businesses. this wasn't stated at the time when my dad took out the credit card/ London Edinburgh.
as my dad couldn't afford to pay the balance interest accrued over time but nothing was heard for 7 years until the debt was sold on to arrow global who contacted my dad via letter and put an inhibition on my parents house so they couldn't sell it with the outstanding balance doubling.
so my question is do they have to settle this account? do they have a case against London Edinburgh who misold the insurance? is this American expresses fault for recommending London Edinburgh as all details at the time would've been accepted before taking the credit card.
my parents are in their 60's and because my dads health is not the greatest my mum worrys that this will be forever a burden.
any help or info on what to do is greatly appreciated.
thanks
cameron

Any complaint would seem to be against Amex.0

There are no "PPI Lawyers", just claim companies who will happily charge a third of any refund awarded to put a stamp on a complaint you could send yourself for free.anyways, can someone help my parents in regards to PPI lawyers that can resolve an issue with insurance
Your parents should write a letter of complaint to American Express. All they have to lose is the price of a stamp.
HOWEVER, it was your Dad's own choice to default on the credit card debt and, even if you are successful with your complaint and the insurance is refunded, the debt will still remain outstanding.0 -

Technically it wasn't my dad who chose to default on his debt as he was relying on the insurance to payout when he was in hospital.
I need to know if I'm to get some sort of forensic lawyer to dig deeper into this! Because it just seems ignorant and against the law to just reply with 'I'm sorry but we don't payout for people who ate self employed when they fine well knew he was'.
I just need to know what my parents options are to get this finally sorted.
Also is debt not wiped out after several years?
Thanks cammy0 -
This insurance was unsuitable as later proven in that your dad could not benefit from taking it out.
Where and how did he fill in the form for the Amex card and ppi? Was it by post, over the phone, in a branch of the bank, online? The answers to these determine who you send the complaint to.0 -

And the reasons for it being mis-sold. If Amex reject it the underwriter may accept responsibility for the sale.
I believe the experts on here will be able to advise you if any redress would be paid towards the outstanding debt.0 -
There are two potential complaints. One is that the policy was mis-sold to your dad. This complaint would be made to the seller - Amex
The other is that the claim (when your dad was ill) was turned down incorrectly. This complaint would be made against the underwriter of the policy. Usually being self employed will affect claims made due to unemployment... however some policies also make it hard for self employed people to use other aspects of the policy too - (.e. the accident and sickness cover.) So you'll really have to see what the policy covered and its exclusions.
There is no reason why you cannot make both complaints, see what response you get and then go to the Ombudsman if you are not happy. However it is unlikely that both will succeed - for example, if it is found that the policy was mis-sold, it is unlikely that the complaint about the claim could go any further.0 -
As already stated, there are no "PPI lawyers", nor are any lawyers required. Make your complaint and, if your complaint is rejected, you can still refer to the Financial Ombudsman. Lawyers are expensive, the complaints process is simple and free.I need to know if I'm to get some sort of forensic lawyer to dig deeper into this!0
