help im being by the bank

hi all


i am trying to claim back about £1700 from hsbc i sent the letter asking for my last 6 years of statements which i got within the time scale then i sent of the next letter saying how much i was claiming for 4 weeks after i sent it i got the "we will look in to it" letter which is i thought ok that gives them 4 weeks left to send me an offer, anyway the 8 week dead line is up next Tuesday so i thought i would give them a call to see whats going on.

when i did get through to someone after waiting over an hour the told me that the claim was started from the 5th July yet i sent the letter on the 4th of June dated the 4th June they then said the 8 weeks would be starting from the 5th July

I feel that they have conned me out of another 4 weeks is there anything i can do to speed things up cos i don't want to wait till the end of August when i should only be waiting till next Tuesday




long story short


i sent my claim letter on the 4th of June which the received


they sent me a letter on the 5th July (1 month after i sent mine) saying they are looking into it

i ring them today 19th July and they tell me that the claim will start from the 5th July and not the 4th June from which i sent the letter

why should i have to wait 12 weeks before they send me an offer when everyone else has to wait 8



any help would be great

    You pretty much have to wait 8 weeks from the date they received the complaint. The delays are caused by the sheer multitude of people reclaiming and some claims are being seen quicker than others thats all. You arent being penalised unfairly or personally, your letter was probably stuck in someones IN tray for a long time with hundreds of others exactly like it.

    Hi tilley,
    The Bank of Scotland tried this on with me, but I had luckily phoned the FOS to ask for an address to send my claim to and they took a note of my complaint and the date. I would think that if you have proof that the letter was signed for by them on a certain date, this would be the date the claim and 8 weeks would begin. Did you send it by recorded or special delivery?

    i didnt send it by recorded or special delivery so i have nothing to prove when they got it

    OOPS!
    Then I think you are going to have to go by the date they say it was received. I was caught out a couple of times at the start with the BOS regarding delivery of letters and dates. They even tried to fob me off by saying my claim on business account had not been received and had been sent to the wrong address anyway, but waited until I phoned 2 weeks later to tell me this. They then argued that the letter I had sent following this conversation would be the date that the 8 weeks would begin. A little chat to the FOS solved this problem and no way were they getting away with this, as it had been the FOS who had given me the address to send the first letter to in the beginning. So since then, everything was sent by Special Delivery. A wee bit more expensive, but at least you have a copy of signature and next day delivery is guaranteed.

    FOS - The Financial Ombudsman Services. You can either pass your claim on to them to try and get a result for you or take the court route. I am using the FOS as I live in Scotland and the small claims limit is £750. My claim is way over this. The FOS are free of charge and as of yet I am led to believe they have had 100% success rate. It costs the banks £400 everytime there is an investigation from the FOS. The only thing is, you have to give the bank 8 weeks to give you an answer before you pass it to the FOS. I would call the FOS anyway and explain that you are in the process of claiming. They will give you a ref. no. and advise you of procedure,

    now i know why they wanted me to wait, its so they could !!!! me over with this new court case and i will now have to wait months thats if i even get anything at all




    grrrr 3 frickin days late for them to send me an offer im startin to think that they done this for a reason
