Received PCN from Parking Eye after using car park at Aldi.
Read the newbies info thread.
Spoken to store manager to get PCN cancelled - said couldnt do it as they do not control parking. Said charge was ridiculous and would take it to the next level within Aldi.Have a receipt and bank stat record.
E mailed joint MDs at Aldi Head Office and copied same email to customer services (both today - no reply yet).
Drafted appeal to parking eye based on advice here (the short version on newbies thread). Going on 3 weeks hols soon so will post appeal to PE as we depart, if they reject then I think I have 28 days from next letter to do POPLA appeal - is that correct?

Spot on.

Many of aldi's parking lie customers like to say as much on Book of Face. Feel free:-) and thoroughly enjoy your holiday in the meantime.
As c-m says, initial riposte is just a fishing expedition for a POPLA code.
I believe, in some rare cases, parking lie have cancelled under onslaught, but making them pay to obtain info, then lose at POPLA is another little pleasure.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:

Aldi have got themselves in to a right pickle here with this lot haven't they.
Lets hope you take the hint and shop elsewhere.I do Contracts, all day every day.0 -
Yes I like voting with my feet ala Aldi is now taboo.
Some people do very lengthy appeals to Parking Lie but it seems the basic short one on the newbies thread missing out mitigation but including proof of shopping will do so think I will use that.0 -
you have done everything correctly
enjoy your holiday, and if necessary you will easily beat them at popla afterwards , suing the post #3 of the newbies thread links0 -
Update - Aldi said they will cancel PCN.
No response from EMail to Aldi Joint MDs office.
Got response from Customer services (copied MDs email to CS) who asked for proof of shopping in order to cancel notice. Proof of shopping Emailed and they have said they will request PEye to cancel the notice.
Will still proceed with short appeal from Newbies thread to PEye incase this does not occur.
Thanks to Ampersand, Marktheshark and Redx for the advice so far.0 -
It will be truly good when you have that proof, mrsc:-)
You have made ParkingLie aware of cancellation advice via Aldi, haven't you?
You require confirmation of this cancellation within 10 working days, don't you?:-)CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:

Update
Sucess
Back from Hols and had 2 letters from PLie one reminding us that we hadn't paid and a second saying the PCN had been cancelled - so the Aldi customer services route worked.
I also sent in the appeal to pLie just in case Aldi didnt get it cancelled.
Thanks to all.0 -
Well done - this keeps happening right now, complaints do work sometimes!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Headline news in or local paper - bad publicity for Aldi - Quote from Whitehaven News
Shopper spends £104 in shop – then lands £70 parking fine
By Julie Morgan
Last updated at 11:20, Thursday, 23 October 2014
AN outraged customer who spent £104 in a Whitehaven supermarket received a £70 fine after being 11 minutes over the car parking limit.
Christine Kearney was queuing at a till in Aldi when her time ran out and she was subsequently sent a fine pointing out she had breached her 90-minute authorised stay.
The car park, shared by Aldi and Iceland shoppers, is private land managed by ParkingEye.
Christine, who lives in Haile, said: “I do a big shop just once a month and like to take my time shopping. On that day I spent £104 in Aldi and was actually queuing at the till when I was over the time. I hadn’t realised.
“When I later received my parking fine I went back into Aldi and told a member of staff. However, they just said there was nothing they could do and I would have to appeal. I was furious.
“If you need to go to both Iceland and Aldi, it doesn’t leave you much time to browse and shop,’’ Christine added.
“I’m not sure if people realise there is a time limit on the car park. I have no idea what will happen at Christmas when people are doing huge shops and the store is very busy.’’
An Aldi spokesperson said: “We would be happy to discuss this further with Ms Kearney. If a customer feels they have been charged incorrectly they can follow the appeals process which is clearly outlined on the reverse of each charge issued.”
A ParkingEye spokesperson said: “Car park users enter into a contract to pay the appropriate amount for the duration of their visit or to not exceed free parking limits. A charge becomes payable if the terms and conditions are not adhered to. We operate an audited appeals process and encourage people to appeal if they feel there are mitigating circumstances. For instance, ParkingEye will review the charge if the motorist appeals with proof of a purchase, however we are yet to receive an appeal for the charge in question.0
