Rent in Advance question – to protect, or not?

    It doesn't matter what it's called - or not called: The £200 meets the definition of HA 2004 S212(8) so it is a deposit:

    Im not ignoring you, just struggling to grasp - is it because the rent in advance, is then overlapped once the LA pays the rent in arrears?
  • The £200 is rent in advance. A landlord who agrees to a tenancy without any rent paid in advance is taking a terrible risk. Any LHA paid in arrears is paid directly to the tentant/s to forward on to you as and when they see fit. If there is a delay in processing their application (and given that the application is unlikely to be processed within a fortnight of moving in) they are going to be constantly in arrears and are going to have a devil of a job in bridging the gap. "First-time renter" suggests they have never lived independently from family before. This makes it unlikely that they have acquired any reasonable budgeting skills, and for people utterly dependent on benefits that has "disaster" written all over it.

    All tenants need to have at least a month's rent in advance plus the equivalent of a month's rent as deposit. If they can't muster the deposit from savings or a loan from family, the Local Authority might be persuaded to guarantee it.

    a) From 30 days after you were paid it?
    b) When the HB/LHA starts being paid to you by the council??
