    As your LL son claims HB, he can't be a lodger, as then he couldn't claim, he also can't be your landlord, as he also then wouldn't be eligible to claim.

    So as it is definite that he is her tenant, I think it follows that you are too.

    So you have the benefit of the laws protection for tenants.
