Hi,
First time poster.
I received a letter today from Parking Eye titled "letter before county court claim"
It goes on to say that they notified me about a breach of terms and conditions in a certain cap park. Saying I need to pay £100 in the next 14 days or further action will be taken and court proceedings will be issued.
My concern is that this is the first I've heard of this. I haven't received any other letters. If I had I would have appealed, got rejected and then gone through POPLA. However it seems to me it is now too late to appeal.
What should I do?
Thanks

No need for deletion as should you have any queries about your case, and/or ultimate help with developing a defence (if it gets that far) then it's on this thread you'll need to post.
Do come back if something isn't clear to you in the stickies, but they will need a couple of reads and taken in bite sized chunks. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Please update your thread as and when you need help along the way. A robust response to a LBCCC is paramount and don't drop the ball - keep up a line of email complaint/challenge as KEEPER not driver, to PE using enforcement@parkingeye.co.uk which they will reply to. Never leave the ball in their court.Golden_balls wrote: »Hi,

Complain to the BPA and DVLA that PE have just sent this letter out of the blue and no Notice to Keeper at all. Email addies are in the Newbies thread.
If the driver was not the keeper then give the name & address of that driver to rewind the clock back so the driver gets a NTK in the post (which they will appeal and win at POPLA, as we always do). Think HARD about who that driver may have been and name them - that's the easiest way.
Finally, complain to the retailer or retail park MD very, very assertively and to the CEO of the shop. Now, urgently. Much better to get it cancelled now before a court claim follows, can be done and is achieved by most posters at this stage. Harder to achieve after court action starts.
DO NOT PAY. I WOULD NAME THE DRIVER. GIVE IT SOME THOUGHT...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, thanks for the reply.
I'm a tad confused. I shall be writing to the PE address you provided. I haven't been able to until now as I was away with work. It's only just occured to me that the 14 days since the LBCCC letter came is very close.
I won't be naming myself as the driver. Are you suggesting I should name somebody else and then go for a POPLA appeal from there?
Apologies for the confusion here. That newies thread is quite a bit to take in and with such little time for me to sort this I need to know the best course to take ASAP.

Edit above post quickly please. Just as you don't admit anything in your response to PE nor do you state it on the forums. PPCs do read them and sometimes refer to specific posts in rejection appeals!Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.0

Thanks Dee.
Coupon_Mad - I've sent you a PM. Not sure if it's gone through as nothing is showing in my 'sent' box.0 -
It's kind of obvious how to deal with this surely, if you want to avoid court. I did say to name the driver to reset the clock - I don't think you have remembered who the driver was yet...have another think. No we don't need a reply starting 'but'.
And no it isn't confusing.
And what happened when you complained a week or more ago when you first posted? Particularly if it was a retailer where that driver was a customer...they cancel these all the time for genuine customers, if a person is assertive enough.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
