  • So … (final question - I promise!) … if only the landowner (Co-Op) or the creditor (CEL?) can try an MCOL … then DEAL can't come after us - right?

    Also, as prior to POFA legislation coming in (it was Jan 2012), CEL can't force my wife (the RK) to tell them who the driver was who would be the liable party … right??

    In which case, they have nowhere to go! Or am I totally off beam??

    You're spot on. The only thing we can't tell at this stage is just what the next step DEAL will take. That's nothing to worry about, you'll just have to wait (with us) to see how it all unfolds.

    Right now this looks a typical phishing trip, which will undoubtedly panic the nervous and supine among the populace to cough up just to make it go away. See yourself among the more savvy and not one to just roll over and open up their wallet to a bunch of unknowns making unwarranted and highly dubious threats.

    Tell us you're not going to pay to make this go away!

    We've been holding out for 2 and a half years … may as well wait a few more weeks to see where they go - i.e. not pay!

    That said, it's always worrying to receive mail like this - and I do worry howe many people give in to these charlatans … don't know how they sleep!

  • What I can find shows they have filed dozens of claims but failed to show up at court.
    They might file hoping for a default win, so start preparing a defence.
    Pre POFA, the I was not the driver is Number 1 and Unlawful penalty charge + ETC 2 and onwards.
    But they have to file first.
    Personally I would write back and tell them you will meet them in court as soon as they can be bothered to file papers and stop writing silly letters.

    CEL have filed dozens of claims and not showed up in court (other than once and got caught with their pants down and shipped a big bill for their trouble), but I'm unaware of DEAL having done this.

    All this stuff has only raised its head over the past few days, although we knew about CEL assigning a large percentage of alleged 'debts' to DEAL back in January of this year.

    Do you have any source for DEAL failing to show in court?

  • Deal can not take you to court.
    Action can only be taken First hand by a land owner, or solicitor working on behalf of an assigned agent.
    If there was a contract or credit agreement they could, but there is not, just a made up invoice.
    They would have to send it back to CEL.
    I do Contracts, all day every day.
