PCN for unloading van in private parking.

My delivery driver received a PCN from Parking Control Management whilst he was unloading the van whilst parked in parking space overseen by them.
The pictures they've taken as evidence show the rear doors of the van to be open.
Just wondering where I'd stand if I were to appeal this ticket, as I'm not sure if the loading/unloading rules apply on private land.

Thanks,

Dan:beer:

Sadly it's the delivery driver that will need to appeal the PCN. Furthermore it is PCM which is an IPC company which makes it a lot more effort to appeal.

I assume this is England or Wales.

Although we are able to help, it does take a lot of work. Who is the van registered to? Who will get the NTK? Is it a work or a private van?

    There are so many variables.

If he/she wishes to appeal, it would be better for them to come here for his/herself.

Rules are made up on private land! They don't follow the real world of real people. You are now in PPC Land .

My instinct is that in this instance if you are feeling kind, you might offer him half the fee to go to Parkingticketappeals.org, who charge £16 to sort this from start to finish. They guarantee to pay any invoice if they lose the appeals.

Certainly the delivery driver might want to be aware of this service as it is useful to know in his role.

But also send him here of he wants to learn how to do it himself.

In the meanwhile have a red of the newbie thread(see my signature) and follow the links in the IAS decisions thread which shows you what PCM appeals have to be like at the second stage. (This thread is linked to in Crabman's sticky, one of the 4 at the top of the forum)
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

As Dee says - they make up their own rules. And PCM are with the IPC which means you need to show us the signs (wording) and not just type here what you think it said. We'll need pictures to help you formulate a decent IAS appeal for second stage if the driver is up for fighting this himself.

So for now the driver should send the template appeal in the 'NEWBIES read these FAQs first' thread near the top of the forum, and get those pics if you can.

And you aren't the driver or keeper of the vehicle so YOU can't appeal the ticket (the driver will have to) but someone needs to do so, quickly, if the delivery van belongs to a firm or lease company who might pay it if they get sent a Notice to keeper. PTA (website found when you Google Parkingticketappeals) is a valid option for just £16 if he'd rather 'get rid of it' easily and stop it ever going to the van owner/lease firm. PTA will appeal such that no letter can be sent out to the employer/owner and PTA guarantee to take the 'risk' from the driver completely.

If the driver panics and pays he'd be a mug. That's not a valid option IMHO.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks for the replies.

The van in question is owned by my company, so the NTK has been sent to me. Sorry I didn't specify this before. Does this change things at all? Should I still use the template appeal in the Newbies thread?

PS I've already saved copies of the pictures locally and will get a picture taken of the parking sign ASAP.

    Thanks again.

Use the template appeal in the Newbies thread, unedited, as it says there, it 'suits all cases'. Don't reinvent the wheel at this stage but start reading up on how to win at IAS stage as you will only have 21 days and it will go quickly. I have linked some recent winning IAS examples in post #3 of the Newbies thread and Dee has her own thread about 'IAS decisions' with linked outcomes, in the 'forum stickies' collated by Crabman also near the top of this forum.

What you also need is pics of the signs - exact wording so we can read it. And a nice pic or two of the entrance if there are no signs there (always good!).

Change the http to hxxp if trying to show us a link to your pics (because you cannot show working links). And have a look at other PCM threads where people have already exposed the omissions in their NTK.
