Banks Revenge.

I too have just taken on Nat West and won although I did have to file in the local court before they made an offer to settle.<o:p></o:p>
<o:p></o:p>
Now they seem to want to extract their revenge, I went into the branch where I hold my account last Friday (the 13th) to withdraw some funds to be told that the account was now closed and I would need to call the customer relation dept for info.<o:p></o:p>

When I did, I was told that all such cases had been referred to a consolidation team that was going through all the figures to make sure the correct amount was repaid, despite the fact that I had agreed on a settlement figure and that amount had already been transferred to my account after waiting the initial 14 days. <o:p></o:p>

So what in effect they are doing is freezing accounts and making you wait another 21 days to be issued a cheque. I don't think this is on and therefore gave them until today to get it sorted out and said that if they did not I would be going into the branch today and would not leave until I had the funds in my possession.<o:p></o:p>

As I have not received anything from them I was good to my word, I went into the bank at 4.25, initially apologizing for what I was about to (it's a small town and I now them all in the bank) After being told by the manager that she could do nothing I refused to leave, then after many phone calls, a lot of whispering and about an hour or so later 2 policeman arrived. I explained my position to them and was eventually asked to leave, legally up to this point I was in the right but once asked by the police and not really wanting to get arrested I left, with the words "I'll see you tomorrow" to the staff. This obviously brought more looks of worry from the manager and more whispered conversations with the police.<o:p></o:p>

A few minutes later the police asked me not to go back tomorrow as they don't want the hassle but that's is exactly what I intend to do and every day until they hand me my cash.<o:p></o:p>

I'm sure that I am not the only one the banks are doing this to, so what I suggest is you follow my suit; if enough people refuse to be told what to do by their banks then they will just give in. <o:p></o:p>

Nic, calm down.
The reason they settled is because you said their charges were unlawful.
They settled because they didn't want to go to court and defend this in case they compromised themselves.
What you are doing with your actions might also be considered to be unlawful and you could get yourself into trouble.
Maybe one of our experts could give you some proper advise on your next step to take.
Please calm down on this one as I'm sure you won't improve things with your bank if you carry out your threats.

You could always write and withdraw your acceptance of the settlement offer on the grounds that it has not been paid and your account has been frozen without prior notice. Then take it to court and take it all the way this time.

I don't think this is right, this account may be my only source of funds and I have kids to feed and obligations to meet therefore I have no intention of backing down. These actions maybe of only a minor inconvenience to them but if they have to call the police every time they shut for the day their tune will soon change.<o:p></o:p>0 -

Ok, i guess i should ask some questions before we start moving along to the FOS mode of advice(which could come after you establish the facts).
Was the account being dealt with by Credit Management Services prior to the claim? If the answer is yes, then the account was due to be closed prior to the claim going in. With CMS the account has to be dormant for a period of time prior to closure and cheque for remaining amount being sent out.

No the account was not with CMS when I started the claim I was notified by the bank just before I recieved thier offer that it had been handed over to CMS as a result of a £300 overdarft that was a result of bank charges, all originating after I made the claim.0

Yes the claim was filed with the court, there were no arrears on the account prior to the claim being made and I have no loans of any kind with the bank0
