20 month old TV - loss of functionality – what can I do?????

    1999/EC/44 gives you two years protection and is statute in UK.
    In a few places it trumps out sale of goods in that you do not have to do the six month engineers report.
    It is about time we used the EU for our benefit.

    Marktheshark, in my earlier response I overlooked your statement: "that you do not have to do the six month engineers report".

    You will be disappointed to know that Article 5 of EU Directive 1999/EC/44 includes that six month rule, using remarkably similar words to those in The Sale of Goods Act.
    Specifically:
    Article 5.
    3. Unless proved otherwise, any lack of conformity which becomes apparent within six months of delivery of the goods shall be presumed to have existed at the time of delivery unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity.

    4 days later I had a voice-mail saying to call them back to arrange for collection and that they would require a refundable £90 fee to cover carriage and tech inspection, and that if it was found that a component had failed prematurely, it would be refunded and the item repaired if spares available. Now in the mean time I have done some research and have found numerous bad reviews of Currys Know How repair programme, about items coming back damaged, scratched, more issues than what they went with, and all the heart ache that goes with it to try and prove your point that it failed prematurely once the product is out of your hands. I'm assuming the main board will need replacing as the HDMI ports seem dead. So have any of you been in a similar situation? what do you think?, what would you do?, can you see any other options? whats the chance Samsung as the manufacturer would send me the spare?

  • Well you don't have many options, Currys have agreed to repair the TV FOC (subject to inspection which is just a formality) Samsung will not want to know, even if they did they'd have a local company take it away and repair it (same risk of it coming back damaged) So your only other option is to buy the part from the likes of ebay and fit the part yourself.

    I would imagine Samsung only sell their parts to approved service centres/agents, I would be very surprised if they sold them to the general public and even if they did I suspect they would cost a fortune!

    I've had some experience with Currys, with me they repaired my TV on site the first time, when the parts didn't cure the issue it was collected and sent away never to be seen again. It went past the 28day mark and they issued a refund - we were paying for the service and the TV was under 12 months old.

    I would let them repair it, take lots of pictures before it goes and scrutinise it when it comes back before the delivery men leave, that's all you can do really.
  • One of the other things i neglected to put was that, a lot of the comments say they never refund the deposit and come up with an excuse. oh well
