Email of Richard Pennycook, CEO Coop/URGENT help with parking fine in NI May 2012

Hi I've been reading theses forums with much interest and though I'd ask for some assistance please.

Firstly the email address of CEO, Coop, Richard Pennycook - I've tried richard.pennycook@co-operative.coop but the delivery failed.

What this concerns is a parking fine from Coop, Lisburn Road Belfast from May 2012.

In summary there was no ticket bought as you could shop for a certain period of time(forget how long) and we were parked in a disabled bay with disabled badge displayed.

We overran the allowed time due to extra time needed with disabled person getting shopping and subsequently received fine notice. The fine notices are in car owner's name who was not driving/present that day.

Have ignored all letters but received Final Reminder before Court Action letter saying pay or proceedings will be issued on 24/09 (!!!!!) in Northampton County Court - need clear direction as to how to proceed please.

Have written email stating the above, eg, disabled, no ticket, time over ran, driver not owner of vehicle to various Coop executive board members but not sure if they received them. The one I sent to CEO failed to send. I have asked them to cancel the fine, strongly complained etc.

Please advise as to my next move - in Northern Ireland, May 2012, driver not owner - but do I need to acknowledge receipt/put defence etc. as am finding the exact procedure confusing and many thanks

  • They do not know who was driving, and as there is no keeper liability in NI (and POFA does not apply), there is not a lot the PPC can do except send threatening letters.

    Keep ignoring UNLESS you get actual papers from the court (you won't).

    This is just an attempt to shake you up into paying.

    Don't waste your time worrying about this in NI - no keeper liability there, so nothing they can do other than issue empty threats.

    Just keep ignoring them. :)

    Thank you for replying, it's difficult to hold your nerve when the amount they claim you have to pay keeps increasing and after all this time they haven't dropped it!!!

    Un-nerving you is exactly what they are trying to do, in the hope that you will be fooled into believing their lies. English courts have no jurisdiction in N. Ireland so they can do absolutely nothing. Of course they could choose to take a claim through the NI court system, but it would be the very first time any parking company had tried to put their business model in front of an NI judge - hell will freeze over before that happens.

    Continue ignoring - do NOT contact anyone at all.

    If you do you are showing you are unsure of the law being different in Scotland and NI - they will rub their hands with glee as their lies are working and making you doubt the true situation.

    They might just be able to fool Northampton into action by omitting to highlight Northern Ireland in your address - not everyone can recognise a NI postcode by the way.

    If Northampton Court do send you any court papers then you respond by informing them that you are a resident of Norn Iron - out of Northampton (or any court in England or Wales) jurisdiction.

    There is no need to prepare a defence as you cannot be prosecuted by a court which has no jurisdiction over Northern Ireland residents.

    You only need to respond by saying where you live, and they will then drop it like a hot potato.

    Thanks for all the advise/reassurance, I'll read that link that was included to get more clued up on this. I have spent a lot of time reading about the whole situation but it's difficult to get the whole picture.

    I tried that email richard.pennycook@cfs.coop but frustratingly it comes back as unknown....I've spent today writing a long/angry letter and I really want to be able to have this brought to the attention of the CEO of Co-op - it angers me that people are getting these threatening letters for years demanding huge sums of money in the Co-op's name - they need to know how out of order this is!!

    Any other ideas on his email would be appreciated but I think I'll send a copy in the post, recorded delivery, for his attention if I can't trace it.

    my opinion, which is of limited experience I admit
    do as has been suggested by more experienced posters


    if you want to complain, go into store, ask for manager, ask him / her for details of ceo and reasons why, give him copy of complaint to pass on in internal mail also inform him you plan to inform local press which will result in negative press re disabled person requiring assistance, reduced sales, tell him / her how much you spend in shop per week / month and that this money will be going elsewhere, as will the rest of your family, friends, work colleagues and neighbours
    lost revenue is the only language they understand

    so I agree with Hot Bring. You could also copy in Deborah Misell-Williams who has been scrabbling to fob off these complaints for months!

    Oh, and get this into the papers if you can. The Co-op should be ashamed of this agent and should be doing a great deal more to protect customers from these threats.
