we would always tell people to fight them all the way, not to pay them a penny , but we dont give legal advice here, just guidance to help people make up their own minds
its totally unfair to ask us to make that decision when it should never have got this far
if you had come here and asked when the pcn arrived, we would have helped you fight it and beat it quite easily, but you didnt, making it harder all round0 -
to be quite honest as stupid as it sounds i forgot about the original PCN as my mum had just been diagnosed with cancer and my mind was not in the right place if i am honest. stupid i know but i cant help that now..
is there a high chance my appeal could be lost/fail?0 -
I can understand the mitigating circumstances, but cannot turn the clock back
I would assume that PE will deny your appeal and not issue any popla code , which they are allowed to do due to the time lag, of that I am in no doubt
the reason you appeal is to head them off before any LBC or MCOL arrives , then if it does you open a dialogue to try and reach agreement, in other words to avoid court , or to try to force them to popla as an ADR in the future
this is why a landowner cancellation is best, its stops things going forward any further, so get it, in writing
by the way, who sent this threatening letter ? I doubt it was PE, probably a debt company0 -
Apologies for the questions as im not of full understanding on all of this. to get a landowner cancelation would i write to the landowner or go into the doctors to speak the person in charge? as for the letter the only name i can see on it. is private eye then a breakdown of cost and a threat of court action.0

Yes an appeal will be rejected. Reset the clock. The driver then gets a PCN and appeals and wins at POPLA.
No reply please talking about who was driving, read the sticky thread about that section. No reply saying 'I can't because...'. Yes the keeper can and should name you as driver.

I thought with the charge being £150 it would be from debt recovery plus or similar as the BPA stipulate £100 maximum for a pcn invoice from a PPC like PE0
