POPLA appeal... quick question

I'm appealing a ParkingEye PCN and will be using one of the templates kindly shared here, however I want to know whether I need to include any evidence? I have two pay and display tickets (the driver ran out and got a second when they realised they had overstayed the 2hr limit in the Morrisons car park), and a shopping receipt which shows they were a genuine customer. They effectively paid for 4 hours parking and stayed for just under 3 hours. Worth arguing or not?

    if you check the popla website, it specifically tells you that mitigation or paying for a ticket will not be considered

    as its morrissons, you should also be complaining to them , or their head office if the local store wont help

    If not: as this is your initial appeal to ParkingEye, it really doesn't matter what you write, whether you include your mitigating circumstances, include any evidence. The main point of this initial appeal is to gain a POPLA code, where you will write a very accurate appeal + evidence + etc.

    However, if you want to add a point D) to the appeal in the sticky about your circumstances, then do feel free. Be sure to only send PHOTOCOPIES of the receipts and your parking ticket from the machines. ParkingEye may well cancel if you spent lots of money in store, or they might not. Get your free proof of posting anyway and see what they come back with.

    Either way,
    1) be sure that you do not name the driver.
    2) If they reject, write a POPLA appeal
    3) if it gets to POPLA, they do not care about mitigating circumstances so you're using normal appeal points.

    If you have appeal to ParkingEye and Have a POPLA Code:

    Then they don't give a damn about the circumstances or evidence of having a receipt. Amend some of the recent ParkingEye appeals (this is one I did a few months back https://forums.moneysavingexpert.com/discussion/5015593) to fit your need and post your appeal here for double checking before you send it to POPLA. You must also make sure you get this done on time as there is a strict time limit in place once you have received your POPLA code.
  • This is already at the POPLA stage, ParkingEye rejected the initial appeal.

    you include any evidence you have, otherwise you dont

    you can add the appeal point as an extra on top of the usual not a gpeol, no contract, poor signage , anpr etc, but popla wont consider it and say so on their site

    you will find the latest lady to email in the newbies sticky thread, she deals with complaints on behalf of Dalton Philips

    Oddly, had you bought up that you spent lots of money in Morrisons, and given receipts and proof of your tickets, PE may have cancelled (unless you did that and they have not). Still, it matters not as winning against them via POPLA is as simple as pie.

    The above is a link to another person who has written a POPLA appeal vs ParkingEye at a Morrisons. You could probably amend their appeal easily to fit your needs.

    Edit: They won simply by proving they were a regular customer to Morrisons. Not even necessarily on the day in question. You can do the same or amend their POPLA appeal which also, would have won.

    If you haven't sent the POPLA appeal yet, I have just added a link to the Newbies thread post #3 'How to win at POPLA' examples, showing specific wording about PE's choice to use yellow signs in Morrisons car parks where all the Morrisons branding & signs are...yellow! Make sure that's featured in your 'unclear signs forming no contract with driver' paragraph.
