Ridiculous parking eye penalty

Hi. Joined this forum especially to make this post and hopefully get some advice. I have just received a parking charge notice from parking eye that was sent to my old address. On the 4th September I went to Newquay to see a friend. I entered the car park at Tower road and before I parked In a bay I recieved a phone call and had to leave. I was literally there for 12 minutes, I didn't park or get out of my car. I didn't even stop my engine. Now I have been told that I have to pay £100 fine that I think is ridiculous!!

What should I do? I could ignore this notice and hope it goes away, appeal against it or just give in to the !!!!!!s and pay them which I am very reluctant to do

Any advice would be greatly appreciated. Thanks in advance

    Dont ignore.
    Do read the sticky thread at the top.

    Challenge it to parking eye (and the landowner too if possible)
    P.E will almost certainly reject
    Draft a winning popla appeal, get it checked and send it off, then the end, thats it, you wont have to pay any silly charge.

    or...
    ignore it all and bin everything, parking eye are extremely litigious and the small claims track of the court is a bit of a lottery.
    To win at court you will need to be well prepared and you will need to put some time in, as well as take some time off work to actually attend court, or you can just forget it all and get a default judgement against you.

    To win at popla you will just need to read through the sticky and spend a little time

    From where I am the choice is easy.

    a lot of these private parking matters can seem ridiculous, but you didnt comply with the terms and conditions of being actually on that private pay and display car park

    but little of that matters as you use the NEWBIES thread to formulate your 2 appeals, one to PE and the other to POPLA and in about 3 months it wont matter as you will have won , but that wont stop it happening again if you STOP on a private car park that requires a ticket and dont pay for a ticket

    Your definition of "parking" isnt the same as the dictionary and only a judge could decide on your version of events, but you wont want it to go that far , hence the 2 appeals based on the NEWBIES sticky thread

    collins english dictionary - parked = (automobiles) (of a vehicle) stopped and left in a place for a period of time
  • Thanks guys and apologies. I should have read the newbies stick first. I have written an online appeal (in vein) to PE. From what I can gather I require some kind of code from them to appeal to POPLA. Is this correct?

  • There's some small print, something about "entering whatsoever."

    There are three PE car parks at Tower Road, the Golf Club, Holy Trinity Church, and the shoddy little cafe.

    The "Grace" period at the lower beach car park "Fistral" is 20 minutes http://www.newquayvoice.co.uk/news/5/article/3428/ haven't seen anything similar for Tower Road though.

    I would have thought the GPEOL argument is your best bet. If it was the Church Car Park, Father Bryan intervened in twelve cases last year.

    Yes follow Half_Ways advice in #3 and you wont be paying Parking Eye !!!!!! all. :money:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

  • According to the Holy Trinity Church website, Father Brian advises that parking on the church grounds is free until 1 p.m meaning that "there’s always time for a cup of tea and a biscuit after Mass".

    However, it looks like ParkingEye have thrown a spanner in the works - the Holy Trinity car park signs now state that parking tariffs apply between 8a.m - 10p.m, 7 days a week. I wonder if they had the courtesy to inform Father Brian?
