only a credit note

Hi all just a quick question. Today my wife popped into a shop to buy my dd a new brownies top. My wife said that she thinks this size would fit dd but if it didn't she would bring it back. Then the woman said that if you bring it back you will only get a credit note is this right is she allowed to do this.

    If the top isn't faulty then yes, she is allowed to do this. There is no right for a refund just because you choose the wrong size, although I'm sure she meant that your wife could exchange or have a credit note, just not a refund.

    Legally she could refuse to give you a credit note, refund or anything at all on a top that's just the wrong size.

    It depends what their own T&Cs state. In theory they could refuse an exchange as well.

    Only as a goodwill gesture. For something bought in error you have no rights to neither refund nor exchange.

    But it would be unusual for a shop not to offer a straight exchange for a wrong size, which is why I said that the woman probably forgot to say credit not OR exchange.

    Just a credit note makes no sense, she would issue a credit note then OP's wife would use it immediately to buy the correct size.

    Legally once you buy anything in a shop you have no right to return it for a refund, exchange, credit note, anything. You have no legal right to take it back at all (unless it is faulty)

    Obviously stores have different policies, but legally they do not have to do anything above the law, and the law is once you buy it in store, its yours (unless faulty :P )
