I was told additional work would be free then charged for it - do I have to pay?

We got married in a marquee and the company laid down flooring as a walkway to the marquee which we were told would be free. They are now asking for payment for this and have sent an invoice! I have emailed them explaining that we were told there would be no charge for this however they have replied demanding payment!

Surely we don't have to pay as we were told it would be free??

  • We were told verbally. Our original written quote did not have anything regarding additional flooring in it.
  • Did you have a written contract with the company? If so, what does it say is included in the agreed price? Is there a mention of the flooring? Does the contract say anything about how 'extras' can be added on and any costs associated with extras?

    Did you ask for the walkway to be put down or did they do it on their own initiative?

    Sorry, lots of questions and no answers, but it's a lot easier to answer with more information rather than putting together a long 'if x then y, if a then b etc etc' response.
    Common sense?...There's nothing common about sense!
  • If it comes to court they've got no evidence. It comes down to 'we said this, they said that'.

    If it were me, I'd send a letter back stating something like 'as per our conversation on xx/yy/zzzz, prior to its installation, the walkway was to be laid at no extra charge to ourselves. The walkway was not required, and we would never have agreed to it being laid for any charge.' I'd then let them take it further if they really wanted.
  • I just had a look at the invoice and it does not mention additional flooring at all. I don't think we have a written contract with them though all we signed was a triplicate form on the day it was erected to say we were happy that it had been erected satisfactorily. This was a tick sheet and did not have costs for any additional flooring on it.

    There was a discussion between me, my husband and the marquee representative which went along the lines of..."is it possible to have a walkway put down?" To which we were told that they could put boards down at no extra cost but that the plastic click-together walkway would be extra. We said okay to the walkway boards being out down only because he said they wouldn't incur a charge.
