Making a house offer in Scotland

Hi everyone,

Just a couple of question's . These are for a home in Scotland.
We have just accepted an offer Friday past for our home , We had seen a property around 2 week's ago and had a second viewing today . Is it possible for us to now make an offer for the property on Monday morning .
We are using the cash from the sale as a large deposit but would still require a modest mortgage, Our financial advisor is visiting Monday night to start the ball rolling with final paperwork etc . We have a decision in principal arleady for a mortgage .

Can an offer go in or do we have to wait till we have a mortgage offer on the address and a signed sale offer also . If so how long should it take to have signed offer in place . I wouldn't like to loose the house we have seen waiting for paperwork etc .

  • Yes, if you have officially accepted an offer on your property and have a decision in principle then that's all that's expected at this stage.

    Your solicitor shouldn't make an offer without being reasonably certain that you can proceed, so consult him or her.

    In general, keeping your sale at least one step ahead of your purchase is an acceptable way to proceed, so you should be able to submit an offer. If you haven't yet concluded missives for your sale then your solicitor ought to be upfront about that with your potential sellers.

    We accepted a verbal offer on our house on thursday morning. Received the written offer from the buyers solicitor on friday.

    We went ahead and offered on a place on the thursday afternoon just after we accepted the verbal offer.

    Just another thing to add......I see folk mentioning speak to your solicitor etc.... I thought your solicitor only really came first into it when you were looking for a written offer to be made eg you had already had your verbal offer accepted then you tell your solictor to then put it to them in writing?

    I honestly didnt think your solicitor was there to advise you in any way up til that point - I would have thought a financial advisor perhaps but not solicitor.

    We have made 2 offers on a house, they are not accepting it, agent says the buyer will accept £x... £21k over the offers over price. We are deciding how to proceed. I would have thought if I wanted to chat to my solicitor or ask for any advice on this he would do me a separate bill as we are just paying conveyancing for selling/buying? Confused!

    A written offer is legally binding so your solicitor needs to be confident that you can proceed otherwise you'll end up in hot water.

    All this negotiation with estate agents sounds too much like the buying and selling process in the rest of the UK.
  • This is often thought to be the case, but you are not tied in until the missives are concluded.

    This is generally done within a few days of a written offer being accepted, but until that point, either party can still pull out without penalty.
