Lloyds taking me to court

Hi, l was wondering if anyone can help me. I entered into a payment agreement with Lloyds bank for my ex back in 2010 for two debts he had with them. They agreed to my making £50 a month payments for both debts. I set up standing orders out of our joint account at the time and l have made payments every month since never missing a month. He received two letters this morning informing him of a change in solicitor for Lloyds for court proceedings indicating that this was to inform him and that the court had been informed also of the change. This was the first l have heard of this, l have gone through all of our recent post and l can not find any notification of court proceedings. All of the post relating to our debts still comes to my address where we lived together before the split.
Can Lloyds take him to court if he is not in breach of the payment plans? Also looking at the amounts they are claiming which l assume will include court costs etc it is going to add just under £2000 to the combined debt. I have online banking and l have checked that the payments are being sent. I am in bits over this and the office is not open until Monday.
I started to self manage mine and my ex-partners debts in 2010 and l could see an end point where we would be in a position to pay everything off but if they add this extra money on it will add an additional year but he will also have 2 CCJ's which will affect his credit for another 6 years and l don't want this to happen as all of our payments have been made for all of our debts for 4 years without fail.
Does anyone know if Lloyds can do this? Any help will be gratefully received

Is there any possibility that hey have a out of date address for you? They might have served against that address if so.
And is the debt over £5,000 (before costs)? If not it is unlikely that costs will be more than £100 or so.
Otherwise I think this might be a mistake. Contact Lloyds Monday.
Also see if you can contact the Northampton Bulk Centre. If there is a claim they might be able to find it.
If the worst happens you have a good case for proving your good payment history and asking the judge to set the same payment.BSC No 248

I also had a letter from Lloyds today saying their in-house litigation has changed and they will contact me when appropriate. It didn't mention anything about court, though. I assume they have done a big mail shoot. It could be they have mixed something up with yours. I would phone them on Monday and check.

shezza, you are not the only one who has had letters mentioning "proceedings" and the court being notified, when they know nothing about any legal action.
Have been a few reports today on various forums.

Maybe maybe not. Or fallout from Lloyds etc stopping using misleading in house collection/sol companies, so having to reorganise and reassign files to do it in their own name.

My son has been trying to open a normal bank account and was told that there was a report on his credit file which was blocking everything.
When he got hold of his credit file through Experian, both Lloyd's and TSB claim he owns them money from debts of over five years ago when he didn't clear overdrafts on accounts he'd closed.
He has absolutely no knowledge of this or has he had any notification or demands from either bank. He's contacted the Ombudsman but neither bank will release details of account numbers that the Ombudsman has asked for, only the amount he owes them (£300+) & (£400) in alleged accumulated charges, and are refusing to co-operate. The guy at the Ombudsman's office did say that this wasn't the first time he'd encountered problems arising out of the Lloyds/TSB split.
He lived with me until a year ago and I don't ever recall seeing any mail for him from Lloyds and TSB. He's at his wit's end - any advice?0 -

People "close" bank accounts and don't realise they have gone £10 over there OD limit, or have forgotten about a charge, or something of that nature, over time, the charges accrue, and before you know it there's a £400 debt owing.

Thanks, I suppose that's possible but why wouldn't they have tried to contact him in some way?

Could be the debt is not even his, someone else, similar name, the fact the addresses do not match up make this option more of a certainty in my book.
I would put everything in writing to the bank, include copies of whatever they have sent him as a reference for them, introduce the possibility the debts are not his, tell them they have 28 days in which to either prove the accounts are his, or to remove all trace of this matter from there systems and his credit file.
If you have no joy, then refer the matter to the financial ombudsman service, and they will sort it all out once and for all.
You must allow the bank time to put things right first though before the FOS can become involved.

If he wants a clear start, let them obtain the CCJ, then consider bankruptcy and he has a clean start in 12 months.
Nothing short of what they deserve as well.I do Contracts, all day every day.0
