They really are taking the Michael here, and sorry but I disagree with coupon I think complaints should be made to try and head this off. A statute barred debt has no chance of going ahead, you seriously need to take this to ico as well as this is serious abuseWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. This behaviour - knowingly chasing statue-barred so-called debts and issuing fake court papers - has GOT to be illegal. That letter quite clearly states that every manjack involved is acting under the instructions of the Co-Op so I'd have though a very stiff letter to the Co-Op threatening referral to Trading Standards and even the police is in order. Also pointing out to them the potential consequences for misleading and aggressive actions come October 1st.
And yes I know the Co-Op doesn't know anything about it but (i) they were stupid enough to engage CEL in the first place and (ii) they have lawyers and deep pockets (compared to the OP) so make it their problem.
P.S. actually scratch "knowingly". There is strict liability under UTR 2008, no need to show that they knew their actions were misleading and/or aggressive.Je suis Charlie.0 -
Yes but if this poster complains NOW it effectively acknowledges receipt of this letter. They are not quite statute barred, unlike the poster on pepipoo who might be. Let sleeping dogs lie for now, a debt collector cannot litigate.
Complaints can wait. Also by waiting then the potential consequences for CEL and their agent's misleading and aggressive actions after that date (1st Oct) are greater.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No you are mistaken, this is not acknowledging anything with cel, the acknowledgement must be with them specifically, so providing that is not done then it's not extending anything I believe. I will ask fermi to take a look at this thread , she's knowledgeable in this fieldWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. It's a confusing and stupid 'pseudo court-papers' letter but clearly the headed notepaper is DEAL.coupon mad..

We can see from the pepipoo poster's pics that they have included fake court papers. They can't even spell ANPR correctly and a debt collector CANNOT litigate.
Basically, ignore that letter but obviously keep it.
To be clear, did you NEVER get a letter earlier this year from DEAL or CEL saying the alleged debt had been 'assigned' 85% to DEAL? Just checking that this is the first letter after many years?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Acknowledging receipt of a letter, or writing to deny a debt, is not acknowledging the debt. According to my reading of the Limitation Act 1980, so long as the OP never acknowledged any debt, then this claim IS statute-barred regardless of how recently or how often he wrote denying the debt.Je suis Charlie.0

Oh OK, that's interesting. I must admit I was very wary of admitting a letter arrived at all if a case is nearly statute barred.Acknowledging receipt of a letter, or writing to deny a debt, is not acknowledging the debt. According to my reading of the Limitation Act 1980, so long as the OP never acknowledged any debt, then this claim IS statute-barred regardless of how recently or how often he wrote denying the debt.
It would be useful to see what Fermi's take on this is.
