6yr 6 month parking ticket

my wife had allegedlly parked in the coop in richmond n.yorks on the 03/02/2008.
we got all the usual bumpf from them and we did the cease and desist letter and heard nothing.....till now.
we have recieved a letter from ce- services saying they are taking us to court for nonpayment of fine(amount £170 or£130 if we pay before 22 sept 2014)so what next, will it go away of its own accord or should i just pay or enter into more dialogue.
when i asked them all those years ago to prove they had photos i recieved no evidence and all i have ever had is begging letters..
will this go to court now, do i need a solicator.(im worried about expense, i just don t have the kind of money to go to court.

A debt (even an alleged debt) from Feb 2008 is 'statute barred' so don't reply or acknowledge that letter trying to re-ignite it.

I assume Sept 2016 is your typo?!

ce-service.co.uk is Civil Enforcement who do try some court claims, so if you get COURT papers then don't ignore those. They are the EASIEST to defend. CEL don't turn up and this is discussed a lot - on pepipoo, the poster emanresu has a signature telling people to 'claim your free £100' in costs from a Judge for your wasted time and money when you show up and CEL don't.

If you get Court papers then post #5 in the Newbies thread is your first point of call, reading ALL links there (but only post #5 of the sticky) to learn what happens when & what to do. Your defence can include an extra point saying the alleged debt is fully denied but in any case, it is over six years old without comms between 2008 and Sept 2014, so it is statute barred and the claim should be struck out at the outset.

You can't re-ignite a debt once its statute barred, once the 6 year period has passed they cannot chase for this money. I would make serious complaints to ICO the DVLA and BPA over this. CEL are taking the proverbial over this. I gather you haven't responded to anything they sent you on this apart from the desist letter, when did you send that?

im not sure as to when the cease and desist letter was sent bout mid/ late 2008 early 2009...?(i dispossed of the letters about 2 yrs ago thinking i t was over)
all communications with them went cold after that letter.
is the six yr limit started at the point of alleged violation or at the last communaction with them as the ping pong letters went on for about a year therefore only making it about 5yrs?
will i have to get a solicator if it goes to court or will i have to turn up its in northampton court, i live in york.

the letter states that due to my continued failure to pay they intend to lodge the relevant papers(they sent me the draft copy) to northampton county court on ....09/14.

If you denied the debt I think it goes from the date of the parking incident, fermi on the debt free wannabe forum would know. You didn't admit to being the driver or anything did you? Know its some time ago, but perhaps you have these letters stored on a computer or something?

Don't worry about it being Northampton. if it did go to court you will defend it and it will be transferred local to you. You don't need a solicitor.


They are just trying it on anyway.

Oh come on you've not even read anything from post #5 of the Newbies thread yet. Of course people DON'T have to go to flippin' Northampton.

Get a grip. You don't need a Solicitor and you are not going to lose a court claim about a 2008 PCN. And did you not even read what I said about claiming YOUR free £100? Jeez we help people beat CEL every time when they try the occasional small claim and yours is even easier, being an ancient PCN they will never be able to get past a Judge even if they did turn up.

It runs from the last comms which is why I said DO NOT RESPOND. Because if you acknowledge a letter in Sept then they may have closed the gap before the 6 years is up. Ignore that one and if they take till, say, December to even think about a court claim (IF ever they were going to, which is NOT certain at all) then they may well be statute barred by then. Doesn't matter either way though, just sit tight knowing they haven't a hope in Hell if they try a small claim. Be ready by reading the Newbies thread post #5.

Clearly CEL are hoping for some default wins from people who have moved house in between. That's not you. You can get your 'free' £100 if they try it.

Surely that's the usual 'Assignment of Debt' letter that CEL use for some silly reason? Oh, I just looked and it's not, it's a desperate debt collector demand from an even older 2007 PCN, LOL!

then it's not from ce-services at all? Detail is important, jimbo k, please be accurate...or is your letter completely different and from ce_services? Clearly that letter is from DEAL.

Yes but in this case they should not even acknowledge they got this letter IMHO, at the moment. Defend and turn up for a small claim hearing, yes, but don't acknowledge this speculative threat and fake court papers. And don't yet complain about it to the BPA or Co-op in this case, let it time out.
