Need help for parking ticket

On 18th August 2014 I park my car at 18:32 in the car park where it says that a 2 hour stay is allowed. I took my son for a swimming lesson and then realised that the swimming pool was open until 22:00. Since all the shops closed at 20:00 in that car park, I thought it would be OK to leave my car there for a bit longer.
After a few days I received a parking charge notice from Parking Eye saying that my car was parked longer then 2 hours and therefore I have to pay £100 fine (and if I pay it quickly then I will get discount of £40).
I Google and found Template appeal letter from parking cowboys and send it to parking eye. Asking them to provide me some information
I received a letter from them advising me that my recent appeal had been unsuccessful because I had not provided sufficient evidence and that several of my queries are of a generic nature and answers can be found under frequently asked questions.
I want to make appeal on the following point:
- All shops in the car park were closed at 20:00
- My parked car therefore was not preventing anyone from shopping and indeed the car park was empty on my return to the car
- On the notice board in the car park it does not mention that this car park is operating 24 hours, which therefore gives the impression you can park longer than 2 hours after the shops are closed (as I did)
Can some one please help me to write official latter

I would not advise to use that information to appeal.
Instead go to the newbie thread (see my signature), read carefully as far as (and including) post 3. Click through the blue link "How to win at POPLA" and use as a basis for the PE appeal, the example that is for a free PE car park.

Appeals are on on legal reasons, not circumstances. Put a draft here if unsure and we will check.

Make sure POPLA code us valid (details in thread) and that you appeal within deadline.

As I type about 10 posts below you ohwhatapalver has written an appeal almost word perfect for you. Have a look at that. Just change the timings etc.
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

They have given you a popla code I gather? You should appeal there as you've practically identified yourself on an open forum where parking eye employ people to look for people like you.

The joke of course is that they are saying your appeal is of generic nature, they are the kings of generic, and issue generic letters 750k times a year, their generic rejections of appeals are generic, their whole business is generic. They do not even read the appeals they just send out generic letters no matter what is written!

That is why that thread is there, just follow the advice, and post here what you come up with, please don't do this without us looking it over for you. You have only one chance with this, don't blow it.

check the popla code is valid on the parkingcowboys checker first

then use the best popla appeal based on legal points, not what you wrote in post #1

as mentioned previously, an appeal is not about "what happened" or "why it happened" , its about proving legal points which means the claimant has to prove their case , and as appellant you query everything and admit nothing

as mentioned above, double check this before submission, by checking with the regulars on here, there is only this one chance of killing this at popla
  • If I add "On the notice board in the car park it does not mention that this car park is operating 24 hours, which therefore gives the impression you can park longer than 2 hours after the shops are closed (as I did)" to ohwhatapalver latter will it make any difference ?

It won't be considered, so no point adding it IMO

Yes - you will blow it.

Look at the words in bold and consider WHY we use template letters to stop people doing what you've done there in ONE sentence.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
