This statement does not seem to fit logically with their original one:Deleted_User wrote: »Thanks but I'm unable to get the Lease from the estate agents. They state as its in the banks hands they can't get hold of it.
Either the EAs have the lease and its Plan, and have identified a problem, in which case they could show you. There is a problem with the lease.Apparently the plan of the flat is not set out correctly.i.e the red lines are not in the right place.
Or they don't have it, in which case they are talking through their backsides......0 -
I've had details from one of the estate agents and they sent me the land registry plan which I already have but looks fine like the said flat.
Now they then state that there is an un-registered lease plan?
Can anyone advise?
They stated they might be able to get some more info tomorrow.0 -
Hi again.
I now have a copy of the lease.
Can anybody have a quick look at it for me please?
What it is is that the original lease plan looks like the whole top floor when it should be divided into two(my flat and the one next door)
The one from the Land registry looks correct which is not on the said lease?
Any advice please?0 -
If the boundary of the flat as defined in the lease Plan includes the flat next door
* lucky you - you'll be buying 2 flats for the price of one!
* possibly when the lease was originally issued it was all one flat? At some later time the floor was divided into 2 flats and the lease was not updated to reflect this. Or perhaps the Plan you have is the original one, and there is a later (correct) one that you have not seen.
How did you get the Plan?
It is possible the Lease Plan will need to be amended. Any decent solicitor could arrange this, though it would require the cooperation of the freeholder, the owner of the lease, and possibly the leaseholder of the other flat too.
This might take time. Whether it would need to be done before you purchased, or could be done at leisure later..... take advice from your solicitor.0 -
Hi GM,
I got the plan from the bank.0
