    Yea kinda figured that out, it's the popla appeal that has to be right isn't it.

    Anyway both submitted online, I'll update as this moves on.

    I don't understand why this appeal is structured in the way that it is. You are appealing to Parking Eye and your appeal looks like a standard forum appeal when, in the majority of such cases, the motorist actually "did something wrong" if I could put it like that without getting flamed.

    Your appeal is different and should be as follows.

    Dear PE,

    I am appealing as the Registered Keeper and not the driver.

    On the day in question, the driver entered your car park with a view to making use of the parking service that you offer. It was not possible to predetermine whether or not there were any spaces before entering.

    After driving round slowly and looking for a parking space, circling the car park twice, he found that there were no spaces available at the time.

    As a result, you, through no fault of your own, were unable to fulfil your part of the contract which was to offer a parking space. You will note that your signs all refer to Parking and not time on the property. Your records will show that the car left after 12 minutes.

    In view of that, I am sure that you will be prepared to cancel the charge or issue me with a POPLA code where I can make representations on this point plus others relating to pre-estimate of loss, signs, etc.

    With PE, I would expect a cancellation on this appeal.
  • I know what you are saying but judging by a lot of things I've read on here and on other sites. For instance the thread on the first page now, regarding the same car park, the same situation and roughly the same amount of time spent in the car park. Which the appeal got refused by parking eye. I don't think it makes a difference what you write, I'm thinking you've probably got more chance of them dropping it, when you send a word for word copy off of here, as then they know 100% what your next plan of action is.

    Not sure that I agree that PE buckle at our forum appeals to them. They don't like our POPLA ones though.

    Our appeals to them are mainly to hook a POPLA code. But they do have a track record of cancelling when genuine shoppers are involved, when you can prove that you bought a ticket but may have screwed entering your registration number etc.

    But your appeal is in and we shall see what unfolds.
  • I'm new so can't link threads, but read the one on the first page relating to the same car park and stopping for 14 minutes 2 minutes longer than me.

    I suspect if they're cheeky enough to send a PCN when it's clear we didn't even park. They'll be expecting an appeal on ones like this and are just gonna reject, no matter what you put.

    I was tempted to try, but tbh, if the appeals to POPLA are as successful as has been mentioned on here, I hope they do reject mine and my fathers, so we can then make them pat the £30 is it? they have to pay when it goes to POPLA. Just for trying to take advantage of people.

    Kinda spoiled the Holiday, we won't be returning to Newquay put it that way.

    Yes it's £27+VAT they have to cough up for each PoPLA appeal.

    Your reaction is exactly why this nonsense needs to be stopped, especially in the West Country where it is rampant. ParkingEye and the landowner may be quite pleased with their little money-making wheeze but this must be hugely outweighed by the cost to the wider local economy.

  • I can't link but, ww.newquayvoice.co.uk/news/5/article/3428/ add a w to the begining and paste that into your browser, it is from 2011, but just read the ton of responses from people who have scammed by parking eye in that area of Nequay. The majority were on holiday, and say the same about never returning.

    I would go with guys dad's appeal. PE never cancel a forum appeal, possibly on principle.

    If PE are sensible they will cancel this. If not, then they only have themselves to blame when they lose £27 at POPLA

    Probably also worth writing to the Vicar of the church to let them know that as a result of PE's actions you will not be returning to Newquay.
