    Well, she might have done something like phone the people on the waiting list who had shown most interest, but then email everyone on a more general list. Or she might genuinely have intended to phone everyone on the list but her manager told her not to because it would be too expensive. It's too vague to be able to complain.

    Thats how we got our house, when we viewed it, it was sold, the foreman took our name to pass on to the sales rep, but she was off sick, so when the sale fell through, they called us as they only had our details

    We got a v snippy call from the rep several weeks later to say she had a lot of upset customers and we should never been allowed to buy the house!!

    Even from your wording, there is no lie. I am working away from home: tonight I will phone all the people I am married to. Even if "they" all answer, I will also email all of them as well. Although, in this case, I hope there isn't another couple interested.

    Her job is to sell houses, not to lead you by the hand. Sounds like she's just about average for sales staff.

    They may have changed their mind and instead of calling sent a generic email.

    How can it be illegal? Your not out of pocket, you are not hurt all it has done is to help you focus your mind on whether you want the property or not. Their job is to increase demand or appear to and make it appear there is not enough to supply that demand.

  • Its good to know the sort of organisation that you are dealing with and this is how they treat you before you sign up it gets worse when they have your money and they still have not finished x.

    Now that being said for some reason people treat new build buying and honesty differently. Clearly you would expect everything an estate agent said to be the complete whole and accurate truth when selling a house?

    You might not see misrepresentation in writing of course which is why if its important ask to see it writing and keep a copy!

    FWIW we've qualified about thirty people in the last month for a release on one of our builder's sites.

    Twelve properties were released last weekend. They were reserved over two days.

    They do not need to ring around. Those hoping to reserve were outside at opening time on the days in question.

    It's a bit like buying an older property via an estate agent. You have to be proactive, ready for when something new comes on the market. No-one really cares who buys it, as long as it's sold quickly.
