Hi all,
Where it says this on this website re Section 75 credit card consumer act: If you stand your ground, it's possible to argue that the indirect relationship constitutes an arrangement to pay. The Court of Appeal decided this was acceptable in 2006, but it's unlikely to be an easy task.
I just wondered if anyone had been denied a Section 75 refund from their credit card company because the payment went through Paypal?And if so, did you argue the above?
I have been told by Barclays that they aren't liable to refund me because I paid for goods via Paypal on my Barclaycard.

Is it worth it? It seems like its a bit of a fight, but does anyone know if the credit card companies back down when arguing this point?

Not that I've ever heard of. They have fulfilled their end of the deal by making the payment to PayPal.
So are understandably disinclined to then take on responsibility for a third party.0 -
Can it be a simple chargeback instead of s75 claim?0

Credit card cos take the same attitude to chargeback claims.
Under s75 a CC pays from their own pocket.
Under chargeback the other side or its bank pays.
Why would the attitude be the same?Perhaps the real question should be; what about Paypal Buyer Protection?

Yes I looked into this but they have a short time limit which has passed for me. Also it only covers goods you receive in the post. Mine was something else.0
