Can we do anything about vendor?

Our house completed at 2pm yesterday. I went to pick up the keys from the agents to be told the vendor was just clearing the last few bits and I could meet her at the property.

Long story short the vendor did not leave until 6pm.

They have left us with full bins, extra rubbish, stuff that will need to be taken to the tip, a washing machine (which would have been ok had we not bought a new one only a few weeks back) and they have not fully cleared the garage.

I am not happy. Can we do anything or is it a case of put it down to experience?

    If yes, you could sue for them.

    In any case change the locks.

    First port of call should be your solictors and take their advice. My push would be for the cost of a skip and someone to load it (and if i were feeling vindictive to deliver it to their new address :rotfl:)

    Do you have a contact number for the vendor. If so the first thing to do is ask when is she picking up the rest of her things - ie washing machine and garage of stuff.

    You could go down the route of getting solicitors involved but realistically for peace of mind and to allow you to move on quickly I'd reluctantly just deal with it. Perhaps shove everything in the garage and get the house straight, coming back to the garage when you have time.

    Annoying yes, but dont let it spoil your new home.

    I don't have a forwarding address, although they did ask me to pop any post over the road to a neighbour and her son left me a mobile and landline number in case their cat comes back, as he's only round the corner, !!!!!!, really?!

    My solicitor has spoken to theirs, they were meant to clear the garage today but as yet, have not done so.

    With regards to the washer their solicitor stated the vendor thought it was to be included and she was happy to leave it at no additional cost.

    I have advised my solicitor I still want it removing and that garage has still not been cleared and am waiting to hear back.

    We changed the house locks last night but as we want the garage cleared the vendor still holds a key.

    My solicitor hasn't really offered any advice! Although I have asked her to clarify where we stand it the items are not removed. I will probably have to pay the council to collect and dispose of the washing machine. There is paint in the shed which seems impossible to get rid of these days and we'd have to do one or two tip runs paying petrol.

    The vendor still has a car out front though she's selling next wk. I did think about leaving her washing machine and rubbish in front of it!

    If it is a working washing machine, and the vendor has said that it is yours, can you not sell it and pocket the cash?

    With the washer, if it doesn't work then most areas have scrap metal collectors, leave it at the front of the drive with a note on it. It will go.

    If it works put it on freecycle, and it will go quickly.

    Or stick it in the garage as a spare if your one ever goes wrong.
    Or stick yours in the garage and try this one out for a few weeks. If it seems in good order then sell your almost brand new one.

    As to the rest of it, I suggest...
    1. Give the vendor reasonable opportunity to collect.
    2. Keep anything you want.
    3. Sell anything worth selling.
    4. Dispose of the rest in the most cost effective way possible. Keep receipts.
    5. Work out what it has cost you. Inform your solicitor how much it has cost you and see if they think it is worth reclaiming the costs from the vendor.

    Unless this is really going to cost you a load of money it's probably not worth the trouble of claiming back. I think Jimmy's suggestions are good.
