Can you be a school governor in an IVA
Sorry, another question, I have just googled bankrupty/school governors, and it is as I thought, you can't be a governor if bankrupt. However, I was quite worried to see that it says you can't be a governor if you are in a composite arrangement to pay creditors - does that include an IVA? I am a school governor, only have collective responsibility for budgets, never individual. Does this mean if I go for an IVA I'll have to give that up? Thanks for any help.

Hi,
You CAN be a school governor whilst bankrupt, and whilst under an IVA too;
Education
25.25 School Governance (Constitution) (England) Regulations 2003 (as amended by the Education (Disqualification Provisions: Bankruptcy and Mental Health) (England) Regulations SI 2006/2198
(paragraph amended September 2009)
An undischarged bankrupt is not disqualified from holding office, or continuing to hold office, as a school governor. URL="http://www.insolvencydirect.bis.gov.uk/technicalmanual/Ch25-36/Chapter25/part2/Part%202%20notes.htm#4"]Note 4[/URL

I became one a year into my iva and am still one. Iva now complete. I did ring our county governor services at the time. They did check and saw no reason. Might be worth checking for your own piece of mind. I didn't give my name so was done anonymously.Don’t put it down - put it away!

Thank you, that's really good to hear. It contradicts what's on the NGA website. Think I will do as above, phone governor services for our local authority direct (but anonymously!). Many thanks.0
