Should you receive the disabled element of Working Tax Credit if you are entitled to the higher mobility rate of DLA.

Yes, my husband works full time. We get a small amount of WTC and at one time got the disabled element. Then they said it had been paid in error and we had to pay it back.
I just wondered if this was right, he had been receiving mobility for a long time before the WTC claim.0 -

Is your husband the one getting the DLA or is it you?

He is getting DLA, this started before the Tax Credit claim.0

In addition to getting DLA your husband will have to show he is at a disadvantage in getting a job. Google leaflet TC956 and you will see what tests you need to pass.
DLA by itself is not enough.
