    I'm with Armorica on this and disagree with the bolded bit of your post in particular - you are getting confused between two entirely different dates! A DD can be taken on a completely different date from the date account payment is actually due, as long as the customer is notified of this in sufficient time.

    I gave two examples of this at post #2 above - Tesco send me a statement on the 10th of every month saying that the payment due date is the 4th of the following month but that (as I choose to pay in full by DD) they will collect this on the 29th. As they are advising me with sufficient notice that they will collect on this latter date (29th), my belief is that they are fully compliant with all the relevant rules and regs, but you seem to be suggesting that they aren't allowed to collect a payment by DD until the actual account due date, i.e. the 4th, rather than the date they say they'll collect. Santander do the same and I'm led to believe that others (NatWest in particular) also collect DDs ahead of due dates.

    I'm not aware of anything in BACS rules (or anywhere else) that establishes a direct correlation between account due dates and advised DD collection dates, but please feel free to demonstrate otherwise!

    No it isn't - it's the final date by which time the payment should have been made. As I stated previously there is a difference depending on what type of account you have but for a credit card payment is due by that date - not after on the next most convenient day.
    It is also the same date that the authorisation under the DD Scheme allows payment to be taken because the DD scheme requires sufficient notice be given for the customer to query the amount.
    So every credit card statement I have had where I pay by direct debit it tells me exactly the date the DD will be claimed. This will vary depending on when the 'due by date' is.

    do not have to pre notified unless there is a change in the date or amount. It is breach of the Direct Debit Sceme rules to take the payment before that date. You can check the rules on the BACS site amongst many others. In practice the credit card issuer may send the request for payment to BACS several days before the due date but it will not be debited to the customer's account until the due date at the earliest.

  • I'm very familiar with the Bacs rules thank you. They don't say what you think they say. They simply refer to when a transaction will be collected not when a debt is due by.

    Your credit card statement will typically give one of two dates - one 'due date' that will apply for whatever payment method you use. If you are signed up for Direct Debits, a date will be specified on which the Direct Debit will be taken from your account.

    The DD rules say nothing about whether your 'due date' should be relative to the date your DD will be collected.
    If there are any changes to the amount, date or frequency of your Direct Debit the organisation will notify you (normally 10 working days) in advance of your account being debited or as otherwise agreed. If you request the organisation to collect a payment, confirmation of the amount and date will be given to you at the time of the request

    is the relevant part of the DD guarantee.

    If they have somehow given you a *payment date* that falls on the weekend, then yes, they can't collect that before, only after. In practice, if you receive a bill every month, then you'll typically be given specific payment dates that avoid the weekend.
