Ignored original as thought it was a scam

Hi There, I am a newbie and have read loads of your threads but have not found one that fits my criteria. I ignored the 'letters' from Parking eye as they looked like photo copies, and I thought it was a scam (even though it had pic of my car). It stated I had parked in a location I had never heard of. It did not state the town, which turned out to be 60 miles from where I live.
The charge is for January. On 8/8 I received a letter from DRP threatening court action. I ignored it.
On 26/8 I received another one, so I phoned them.
During conversation I probably admitted I was driver but stated I did not know where this car park was and also that I thought the original was a scam.
She made a note of what I had said (I could hear typing) and said that if I paid within the day she would reduce it by 20%
I said I wanted to speak to my insurance company as I have legal cover, to see where I stand.
She made a note on my account.
I now have either to pay by tomorrow or to ignore it.
Now I know you keep saying that it is not a parking ticket and that I should not have to pay it, but I have also admitted liability and also not sent an appeal.
Any advice please?

    Send an online appeal to PE on their website (the PCN tells you the webpage). IGNORE DRP. FOR THE LOVE OF GOD STOP PHONING DRP. AND DON'T PHONE PE!

    Use the template appeal in the newbies thread. Add a point D that as keeper you have no idea where this car park is, and it's difficult to know who was driving or whether this was even your vehicle, because the PCN did not specify a meaningful location and the photos looked altered, like bad photocopies. The PCN stated the car was parked in a location with no town given, which you think is 60 miles from where I live and so you are not liable.

    See what they come back with - DO NOT IMPLY WHO WAS DRIVING.

    You have NOT. But stop talking to pointless pen-pushers at a debt collector call centre. What do you think their whole agenda is?! COLLECTING MONEY!

    Put that right, sharpish. Read the NEWBIES thread, the parts about 'too late to appeal, you think?' and resetting the clock by naming the driver who of course you might recall, when you think hard... wasn't the registered keeper, after all that day.

    stop phoning DRP is the first piece of advice we can give

    clearly you DID NOT read the NEWBIES sticky thread at the top of this forum ?

    it has a full section in there about debt collectors including DRP , telling people to ignore them

    if you had read the newbies thread properly, it also tells people to appeal to the PPC, no matter how long has passed , so you need to appeal to PE directly, with the template letter , online or by post with free cert of posting at the P.O.

    and there are several similar threads to your "circumstances" so clearly you didnt find one, but they are here as I have read them

    PE take thousands of people to court every year, so you need to open a dialogue with them to try and avoid court, ignoring them tends to lead to an MCOL, which you wont be ignoring (I hope)

    beyondhelp, you are 100% right about one thing..... it is a scam, take all the advce off fellow fourmeers and stand up and beat the scammers.
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
  • Can I just ask how long do I wait for a response to my appeal? It was emailed on 8/9/14 but I have not received any reply at all. just more letters from DRP

    Thought you had named the driver, to reset the clock, which would have got a PCN sent out to that person (100% winnable from that point)?

  • Hi there
    Cant name the driver as I dont know where it occured, as only given name of car park not town in which it was. So cannot be sure of who was driving. I added that in the appeal but have received no reply from them. Should I contact them again and ask for reply? or tell them that as I have not heard from them I take that as an acknowelgement that they have cancelled the charge and they will call the DRP off.
    Or should I just leave it?

    Non-compliant NtK then. A Notice to Keeper must specify the land where the vehicle was parked. Simply naming the car park is no good if it's only meaningful to people who already know where it is!

    So you could write to PE telling them that you've never heard of the car park, you've no idea where it is, and accordingly their Notice to Keeper failed to comply with the Schedule 4 requirement to specify the relevant land. Accordingly they cannot hold you liable as keeper and can only pursue the driver - and you've no idea who that was.

    As above. As it is PE, best to send something like bazster's post above. And get a certificate (free) of posting when you send it.
  • would you also suggest sending a copy of the appeal? mentioning it? or ignore it all together? Sorry to be such a pain.
