    excellent news, as we seem to have luton and birmingham vying for business on here at the moment , and 2 rewrites and links to newer appeals should be ideal given how often they come up , whereas the JLA ones are excellent and recent

    its time APCOA were reported to the DVLA and the BPA each and every time they use POFA 2012 to try to justify writing to registered keepers over airport pcn`s by these affected owners too , same as the ongoing ABP one in southampton and PE
  • Thanks very much to you all. I had copied two different versions and was wandering which was best so the clarifications above are really helpful. I will definitely report them to the DVLA/BPA as well.

  • Many thanks for this - I found this thread really helpful as I've just had a similar letter from APCOA rejecting my appeal for an alleged "Dropping off / Picking up outside of a designated parking area" contravention at Birmingham Airport. I'll use the above suggested appeal to POPLA template and also want to complain to DVLA and BPA (how can they possibly assert keeper liability and claim they aren't using POFA?!!). Are there templates for the complaints and should I wait till after the POPLA appeal?

    Also - are they getting cuter re GPEOL? Their letter rejecting my appeal says "The sum, and calculations which have been made in setting it, have been approved and agreed by the landowner". They also included a purported letter (obviously not the contract!) from Birmingham Airport confirming their authorisation to issue PCN's, access DVLA data and take legal action to recover unpaid PCNs.

    Birmingham Motorist. It is good that you have followed and understood the process of appealing and found this relevant appeal. I trust you appealed as keeper, not driver.

    Ignore their attempts re GPEOL and contract. They are trying to pull the wool over your eyes.

    Please however start your own thread for any questions as it is a general rule of thread, one PCN per post. Or indeed in response to this post.

    And no there are no templates for complaints. It is better if each individual write their own.

    Given such 'cast-iron documented proof;), their shyness in providing a copy is curious.
    Where is their pride in having dispatched a cornerstone of most successful appeals? :-)

    Someone must be on the works scooter, pedalling to landowner with abacus, crayon and paper for every single parking event.

    'APCOA must provide a full, dated, contemporaneous, unredacted copy of the calculations for this specific parking event, as presented to, and subsequently signed by, the landowner'.....

    As this may well be an attempt to obtain monies by misrepresentation you should forward the papers to you local council Trading Standards department.
    You never know how far you can go until you go too far.
