CEX faulty PS3

Yesterday my partner traded in some games and controllers at CEX to get our daughter a PS3. When he got it home it will load the main page fine but wouldn't load any games. He restored the settings (this took 6 hours), and tried again, still nothing except this time it wouldn't release the disc. Today he took it back to CEX, where as soon as he mentioned the word "returning" the manager appeared. He looked at the PS3 on the front desk then disappeared into the office and made a phone call. He returned, plugged the PS3 in and tried to eject the disc, it wouldn't. He then took off the removable top cover and said "you've tampered with it, you're not getting a refund" As my partner tried to tell him that he hadn't, the manager continued to repeat, "you've tampered with it, you're not getting a refund". He then put the console back in the carrier bag and told my partner to leave or he would call the police because my partner was shouting at him (he wasn't). My partner then left the store. Personally i would have stayed and let them call the police, but hey that's me.
So any advice on where we go next? Contact head office Via email/snail mail? Citizens advice? Trading standards?......

    CEX are franchises, they're also notoriously poor - so don't expect much. I'd be back in and if the manager wants to call the police I'd let them & explain to the police that the manager is falsely accusing him of something he did not do & is refusing point blank to accept his responsibilities as a retailer. If it gets resolved I'd be straight down to a reputable retailer such as Game where their preowned gear has 12 months warranty.

  • And if the police are called the manager will state that the person has been told to leave as he was being abusive to staff and is no longer welcome on private property. The police won't intervene on a civil dispute between the consumer and retailer, but will remove you from the premises for trespassing/keeping the peace.

    Try again, but you may have to go through the courts if instore and Head Office won't budge.
