Oh I am not expecting them to solve the problem for me, just to make sure he get banned by eBay as a seller.

If you tried to report the seller, the first thing you would have to provide is the ebay transaction number. As you wouldn't be able to do this, there would be no way to fill in any report details.

Yes, yes, but my point is that he advertised it in a way such that when sent to the recycling factory, points will be awarded.
Not quite. He stated that there wasn't a guarantee that the points would be awarded.
You are not buying any tesco clubcard points or a guarantee to receive any.

As you were aware that you would be breeching the terms of the offer, you must have had an expectation that the application might be rejected.

The answer to the question "Bought ink cartridges off eBay for recycling but received no Tesco points - can I sue" is yes. Anyone can sue anyone.

It's not the right question to ask though.

I asked if there is a realistic chance of winning?

Very little chance at best and most likely no chance.

It's unlikely. For a start you haven't purchased the listing so anything written in that is irrelevant.
What did the Paypal invoice say?
Have you had acknowledgement that the cartridges you purchased were sent to the recycling centre and received by them?
You have been duped by someone, at this stage I'd try Trading Standards and see if they can help. You could do with the seller's address, you may be able to get some further info from the Paypal transaction to help with that.

trading standards? but it says on their website
'Unfortunately we cannot help with your individual complaints - that's the job of Citizens Advice Consumer Advice line and your local authority trading standards service.'
    do you mean something else?

I do not have a paypal invoice, but we have email correspondence. I have rang the recycling factory and they told me this is the case. I made it clear to the seller when I contacted him.

Was it the HP cartridges that are now excluded from the recycle program because of ebay sellers by any chance?

Quick search and i found this
Please note that from Monday 21st July 2014, HP 364 cartridges will no longer be eligible for points on the Tesco ClubCard scheme. Cartridges that are processed after Friday 18th July 2014 will automatically be donated to Tesco’s charity of the year, Diabetes UK.

As tesco aren't the qickest at processing i think you probably fell into that timescale and as such i'm sure your donation has now been gratefully received!

No, "your local authority trading standards service" is what we're telling you. Each local authority has their own Trading Standards. You'll find them on your local council pages.
