Notice to owner received- PCN was supposed to have been cancelled

Hi, hope someone can help , I have read through loads of information on here but im still unsure what to do.


on the 31st July we took my elderly father in law shopping to Asda, we parked in a disabled bay with his blue badge on display, however on returning to the car we found a PCN stuck to the windscreen. We went back in the store and spoke to one of the management team who eventually agreed to phone parking company ( smart parking). After this phone call we were assured that the PCN had been cancelled.
Yesterday (6/09/14) we received a notice to owner stating that the charge of £70 is still outstanding. I phoned them to explain that the charge had been cancelled by Asda but the call handler was adamant that it wasn't possible for asda to cancel the charge!!
He advised me to send copies of the Blue Badge and the appeal slip, which I was about to do but to complicate matters I have realised that the badge has in fact expired several months ago !!


I have emailed asda customer services but their response was to A) don't worry about it if the store told you it was cancelled and B) they cant help but I could try visiting the store again !!


I am aware that the blue badge scheme doesn't cover private land But what do I do ? should we pay up ? do I appeal ? if so on what grounds ?

sorry for the long winded post ! Any advice would be gratefully received

    take it to popla and cost them £30 (after appealing to not so smart)

    dont pay up, that is foolish

    the EA 2010 covers this so complain to asda head office CEO

    and try reading the NEWBIES sticky thread, then you would know "what grounds"

    read it several times, appeal using the template "as is" (thats not hard)

    then complain to the asda ceo direct

    try and get the cancellation in writing from asda

    Smart usually cancel at template appeal in post 1. This is honestly one of the easiest PPCs to beat!

  • should I add something to the template appeal letter quoting the EA 2010 ? or is that just something I should take up with Asda ?

    Save EA2010 for POPLA. You could mention it to asda but not worth it in initial appeal.

    the parking company/BPA ltd do not care about the equality act, all they want to do is to taker your money..

    While you shouldnt take your eye off the ball with regards to POPLA etc etc, you should complain again to the ASDA store, tell them what has happened, tell them that their agent has refused to cancel, show the manager any evidence ( ie blue badge) and tell them that unless they cancel you may/will hold that ASDA in breach of the equalities act over the behavior of their agents (smart parking ) for who they (asda ) are responsible for.
