  • Thanks everyone. I have submitted the material online now via the Popla website.
  • I've received an email from Popla to say:

    The Assessor has considered the evidence of both parties and has determined that the appeal be allowed.

    The Assessor’s reasons are as set out.

    The Operator should now cancel the parking charge notice forthwith.


    Considering all the evidence before me, I find that the operator has provided

    a list of heads of loss but has not ascribed amounts to each. Therefore, as the

    head of loss for overheads is not a loss which can properly be claimed as a

    genuine pre-estimate of loss, since it does not flow from the breach, and I am

    unable to know how much of the genuine pre-estimate is composed of that

    head, I am unable to know whether the appropriate heads of loss add up to

    a sum represented by a charge of £75. Therefore, I must find that the charge

    does not represent a genuine pre-estimate of loss, and is an unenforceable

    penalty.
