Consumer rights when overseas

Hope someone can help with this one.

I bought a laptop last Christmas in the UK and shortly after that moved to New Zealand.

I've had a lot of problems with the laptop since I bought it, but because there are no authorised Mac retailers in NZ I'm reliant on the helpdesk. I've spent hours on the phone with them trying to resolve the problem, but every 'solution' they present me with makes no difference and just takes up more of my time.

There's obviously something wrong with it and at this point I just want a replacement.

However, I'm not clear whether I can use my UK consumer rights - which would entitle me to a replacement - or NZ ones, which aren't so clear-cut. The computer does have a UK warranty (which is still valid) that also entitles me to a replacement.

If I'm outside the UK can I invoke either UK consumer rights or the UK warranty?

    If you have Applecare then
    The AppleCare Protection Plan for Mac, for iPod, for Apple TV and for Apple Display provide global repair coverage. Service will be limited to the options available in the country where service is requested. Service options, parts availability and response times vary by country.

    Not sure about consumer rights from abroad

    I can't see them sending it to NZ or you having a right to such.
    their terms will state the jurisdiction of the contract, can't see it being anything other than the UK though

    Does your UK warranty have International coverage? They may only specify UK and maybe EU. Have a good read through it.


    Your contract is with the retailer who you bought it through in the UK, not directly with Apple, unless it was via their own shops. I cannot see them covering you though under their UK warranty so far away. Have a go at the links Kris has given you.

    Where on earth did you get this idea? A very quick search found 3 Mac service locations on the Apple NZ website in Wellington alone.

  • Thanks all. The warranty does cover overseas, but only for repairs if Apple deems they're needed.

    Given that the warranty goes above and beyond consumer rights, I wondered which - if any - consumer rights apply in this situation.

    There are no actual Apple shops here, just places that have people trained to do repairs to Macs. These are what are listed on the Mac site. They will do a repair, but I want a replacement as the machine has been a dud from day 1.

    I did buy it from an Apple shop so it's helpful to know my contract is with Apple - thanks for that.

    You cannot insist on replacement, you must offer them the opportunity to repair it. From what you have said you haven't yet had a repair...

    As above, no right to a replacement whatsoever. The retailer can repair, replace or refund at their discretion. And if it's an RTB warranty, you''ll have to ship it back to Apple at your expense.
    No free lunch, and no free laptop ;)
